The Secretary of State, and the National Assembly for Wales, acting jointly, in the exercise of the powers conferred on them by sections 9(2) and (2A) and 67(5) of the Adoption Act 1976(1) and sections 16(2), 34(1) and 118(5) and (6) of the Care Standards Act 2000(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:—

1976 c. 36. Section 9(2) of the Adoption Act 1976 (“the 1976 Act”) was amended by section 116 of, and paragraph 5(6)(a) of Schedule 4 to, the Care Standards Act 2000 (“the Act”). Section 9(2A) of the 1976 Act was inserted by section 116 of, and paragraph 5(6)(b) of Schedule 4 to, the Act. These powers are exercisable by the appropriate Minister, who is defined in section 9(5) of the 1976 Act, in relation to England, as the Secretary of State and in relation to Wales as the National Assembly for Wales and in relation to England and Wales, as the Secretary of State and the National Assembly for Wales acting jointly. Section 9(5) of the 1976 Act was inserted by section 139(2) of, and paragraph 4(1)(b) of Schedule 4 to, the Adoption and Children Act 2002 c. 38 (“the 2002 Act”).

2000 c. 14. These powers are exercisable by the appropriate Minister, who is defined in section 121(1) of the Act, in relation to England, Scotland or Northern Ireland, as the Secretary of State, in relation to Wales as the National Assembly for Wales and in relation to England and Wales, as the Secretary of State and the National Assembly for Wales acting jointly. “Prescribed” and “regulations” are defined in section 121(1) of the Act.
