Citation and commencement

1.  This Order may be cited as the Regional Transport Partnerships (Establishment, Constitution and Membership) (Scotland) Order 2005 and shall come into force on the day after the day on which it is made.

Interpretation

2.  In this Order–

“the 2005 Act” means the Transport (Scotland) Act 2005;

“constituent council” shall be construed in accordance with section 1(2)(b) of the 2005 Act;

“member” means councillor member and other member of a Partnership but does not include an observer;

“other member” means those members referred to in section 1(2)(c) of the 2005 Act; and

“Partnership” means a Transport Partnership established under article 3(3) below.

Establishment of regional Transport Partnerships

3.—(1) For the purposes of Part 1 of the 2005 Act, Scotland shall be divided into regions in accordance with paragraph (2) below.

(2) Each region shall comprise of the areas of those constituent councils, or parts thereof, as specified in column 2 of Schedule 1 to this Order, subject to any qualifications contained in that column.

(3) For each region there shall, with effect from the day after the day on which this Order is made, be established a body corporate to be known as the Transport Partnership with the addition of the name given to that region by the corresponding entry in column 1 of Schedule 1 to this Order.

(4) Once established a Partnership may decide to change the name given to their region and if they so decide the Partnership shall notify the Scottish Ministers and its constituent councils of the change of name of the region.

Constitution and membership of Partnerships

4.  Schedule 2 to this Order (which makes provision as to the constitution and membership of each partnership) shall have effect.
