The Department of the Environment is a department designated(1) for the purpose of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the conservation of natural habitats and of wild fauna and flora.

These regulations make provision for a purpose mentioned in section 2(2) of the European Communities Act 1972. It appears to the Department that it is expedient for any reference to an Annex to Council Directive 92/43/EEC(3) on the conservation of natural habitats and of wild flora and fauna to be construed as a reference to that Annex as amended from time to time.

In exercise of the powers conferred on it by section 2(2) of, and paragraph 1A(4) of Schedule 2 to, the European Communities Act 1972, the Department makes the following Regulations:

Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora was last amended by Council Directive 2006/105/EC of the 20 November 2006 adapting Directives 79/409/EEC, 92/43/EEC, 97/68/EC, 2001/80/EC and 2001/81/EC in the field of the environment, by reason of the accession of Bulgaria and Romania.
