The Department of Agriculture and Rural Development(1), in exercise of the powers conferred on it by Articles 12(1) and 60(1) of the Diseases of Animals (Northern Ireland) Order 1981(2) and of every other power enabling it in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Foot-and-Mouth Disease (Infected Area) Order (Northern Ireland) 2001 and shall come into operation on 27th February 2001.

(2) In this Order “infected area” means an area declared by the Department to be infected with foot-and-mouth disease in accordance with Article 2.

Declaration of foot-and-mouth disease infected area

2.—(1) Where the Department has grounds for suspecting that foot-and-mouth disease exists within Northern Ireland or within such part of the Republic of Ireland as may entail the risk of the spread of that disease into Northern Ireland, it may by notice in writing declare Northern Ireland or any such area as may be specified in the notice to be an infected area.

(2) A notice given under paragraph (1) shall:

(a)be published in such manner and to such extent as appears to the Department to be sufficient to bring the terms of the notice to the attention of those persons likely to be affected by it;

(b)specify the date on which it shall come into operation; and

(c)remain in operation until revoked by a further notice published in like manner.

(3) A notice given under paragraph (1) may be varied by the Department and any such variation shall be in writing and published, so far as practicable, in the same manner and to the same extent as that notice.

(4) Subject to paragraph (5), any premises partly within an infected area shall be deemed to be wholly within an infected area.

(5) Nothing in paragraph (4) shall deem any area outside Northern Ireland to be an infected area.

Effect of declaration of infected area

3.  Notwithstanding Article 21(1) of the Foot-and-Mouth Disease Order (Northern Ireland) 1962(3), all the provisions of that Order, insofar as they are applicable, shall have effect in relation to the infected area.

Explanatory Note

(This note is not part of the Order.)

This Order provides that where the Department of Agriculture and Rural Development has grounds for suspecting that foot-and-mouth disease exists in Northern Ireland or in such part of the Republic of Ireland as may entail the risk of its spread into Northern Ireland it may by notice in writing declare any area in Northern Ireland to be an infected area. Such a notice must be published and must specify the date on which it comes into operation. A notice may be revoked or varied.

Where an area is declared to be an infected area then the provisions of the Foot-and-Mouth Disease Order (Northern Ireland) 1962 (insofar as they are applicable) shall have effect in relation to that area. The main restrictions imposed are prohibitions on the movement of animals out of, into or within an infected area except under the authority of and in accordance with the conditions of a licence.
