Amendments to Commission Delegated Regulation (EU) 2019/2016: refrigerating appliances

6.—(1) Commission Delegated Regulation (EU) 2019/2016 is amended as follows.

(2) In Article 2 (definitions), in point (31) (definition of ‘mobile refrigerating appliance’), for “electric mains operated” substitute “connected to the mains through an AC/DC converter purchased separately”.

(3) In Article 3(1) (obligation of suppliers), for point (b) substitute—

“(b) the information set out in Table 6 of Annex 5 (product information sheet) is made available on a publicly accessible website;”.

(4) In Annex 1 (definitions), after point (41) insert—

“(42) ‘declared values’ means the values provided by the supplier in the technical documentation in accordance with point 1(d) of Annex 6 for the verification of conformity by the market surveillance authority.”.

(5) In Annex 4 (measurement methods and calculations)—

(a) after the first (unnumbered) paragraph, insert—

“Where a calculation in this Annex uses a parameter listed in Table 7 of Annex 6 (technical documentation), the supplier must use the declared value for that parameter.”;

(b) in point 1 (general conditions for testing)—

(i) for point (h), substitute—

“(h) the freezing capacity of a compartment must be calculated at 24 times the light load weight of that compartment, divided by the freezing time to bring the temperature of the light load from +25 to -18 °C at an ambient temperature of 25 °C, expressed in kg/24 hr and rounded to one decimal place;”;

(ii) for point (i), substitute—

“(i) for 4-star compartments, the freezing time to bring the temperature of the light load from +25 to -18 °C at an ambient temperature of 25 °C must be such that the resulting freezing capacity complies with the requirement in point (4) of Annex 1 (definition of ‘freezing capacity’);”;

(iii) after point (j) insert—

“(k) the light load weight for a 4-star compartment must be calculated at 3.5 kg per 100 litres of the volume of the 4-star compartment, rounded up to the nearest 0.5 kg, except that it must be deemed to be 2 kg if that calculation results in a value lower than 2 kg;

(l) if the refrigerating appliance includes a combination of 3-star and 4-star compartments, the sum of the light load weights must be calculated at 3.5 kg per 100 litres of the total volume of all 4-star and 3-star compartments, rounded up to the nearest 0.5 kg, except that it must be deemed to be 2 kg if that calculation results in a value lower than 2 kg.”.

(6) In Annex 5 (product information sheet)—

(a) in Table 6—

(i) under the heading “General product parameters”, in the second column of the entry relating to “Annual energy consumption (kWHa)” for “x,xx” substitute “x”;

(ii) under the heading “Compartment Parameters”, in the fifth column of the entry relating to each of the following parameters, for “x,xx” substitute “x.x”—

(aa) “4-star”;

(bb) “variable temperature compartment”;

(iii) omit the row beginning “Light source parameters” and the two rows following it;

(iv) after the entry relating to “Fast freeze facility” insert—

(v) omit footnotes “^b” and “^c” and the references to those footnotes;

(b) after Table 6 insert—

“3.   The following items in Table 6 are not relevant for the purposes of determining whether a model is an equivalent model under Article 2(6) of the Framework Regulation—

(a) supplier’s name or trade mark;

(b) supplier’s address;

(c) model identifier;

(d) overall dimensions (millimetre);

(e) airborne acoustical noise emission class (dB(A) re 1 pW);

(f) minimum duration of the guarantee given by the supplier;

(g) additional information.”.

(7) In Annex 6 (technical documentation), in point 1, for point (a) to the end substitute—

“(a) a general description of the model, sufficient for it to be unequivocally and easily identified;

(b) references to the designated standards applied or other measurement standards used;

(c) specific precautions that must be taken when the model is assembled, installed, maintained or tested;

(d) the values of the technical parameters set out in Table 7;

(e) the details and the results of the calculations performed in accordance with Annex 4;

(f) the testing conditions, if not fully described in the information provided under point (b);

(g) the model identifier of all equivalent models already placed on the market.

If a certain compartment type is absent, the values of the compartment parameters must be recorded as ‘-’.

(8) In Annex 9 (verification procedure for market surveillance purposes)—

(a) for the first (unnumbered) paragraph substitute—

“The verification tolerances set out in this Annex relate only to the verification by the market surveillance authority of the declared values.

The supplier of a product must not use the verification tolerances—

(a) to establish the declared values;

(b) to interpret the declared values; or

(c) to communicate better performance.

The values and classes published on the label or in the product information sheet must not be more favourable to the supplier than the declared values.”;

(b) in point (2)(a), for “values given in the technical documentation pursuant to Article 3(3) of Regulation (EU) 2017/1369 (declared values),” substitute “declared values”;

(c) in the final paragraph before Table 8, for “points 1 to 7” substitute “points 1 to 6”;

(d) in Table 8—

(i) in the first column, for “E₁₆E₃₂” substitute “E₃₂”;

(ii) omit the entry relating to “E_aux”;

(iii) in the second column of the entry relating to “temperate rise time”, for “higher” substitute “lower”.
