Dim rhwymedigaeth i fwrw ymlaen os nad yw'n briodol

11.—(1) Nid yw'n ofynnol i asiantaeth sy'n darparu gwasanaethau cymorth mabwysiadu o dan reoliadau 2(2)(d) neu (dd) ddechrau darparu gwasanaethau o'r fath, neu ar ôl iddi ddechrau darparu'r gwasanaethau hynny, nid yw'n ofynnol iddi barhau i'w darparu os yw'r asiantaeth o'r farn na fyddai'n briodol iddi wneud hynny.

(2) Wrth benderfynu a yw'n briodol iddi ddarparu'r gwasanaethau hynny (neu ddechrau darparu'r gwasanaethau o'r fath), rhaid i'r asiantaeth roi sylw i'r canlynol:

(a)lles y person a fabwysiadwyd sy'n gofyn am y gwasanaeth;

(b)lles y perthynas sy'n gofyn am y gwasanaeth;

(c)unrhyw feto a gofnodwyd o dan reoliad 13;

(ch)unrhyw wybodaeth a ddelir gan y Cofrestrydd Cyffredinol ar y Gofrestr Cyswllt Mabwysiadu;

a holl amgylchiadau eraill yr achos.

(3) Rhaid i asiantaeth beidio â dechrau darparu gwasanaethau i berson a fabwysiadwyd nac i berthynas i'w cynorthwyo i gysylltu â pherson sydd o dan 18 oed, na pharhau i ddarparu gwasanaethau o'r fath—

(a)oni bai bod amgylchiadau eithriadol, a

(b)oni chydymffurfir â darpariaethau paragraff (4).

(4) Rhaid i asiantaeth beidio â bwrw ymlaen â darparu gwasanaethau o'r math y cyfeirir atynt yn is-baragraff (3) oni bai—

(a)bod person gyda chyfrifoldeb rhiant dros y plentyn wedi cydsynio, a

(b)bod naill ai

(i)y plentyn, a hwnnw'n blentyn sy'n gymwys i gydsynio, wedi cydsynio, neu

(ii)unrhyw ddymuniadau neu deimladau gan blentyn nad yw'n gymwys wedi'u cymryd i ystyriaeth.
