Sefydlu Pwyllgorau Cymhwysedd Proffesiynol

6.—(1) Rhaid i'r Cyngor sefydlu un neu ragor o bwyllgorau i'w galw'n Bwyllgorau Cymhwysedd Proffesiynol er mwyn cyflawni'r swyddogaethau y cyfeirir atynt ym mharagraff (2).

(2) Swyddogaethau Pwyllgor Cymhwysedd Proffesiynol yw—

(a)penderfynu ar achosion a gyfeirir atynt gan Bwyllgor Ymchwilio pan oedd yn ymddangos i'r Pwyllgor Ymchwilio bod gan yr athro neu'r athrawes gofrestredig achos i'w ateb—

(i)mewn perthynas ag anghymhwysedd proffesiynol difrifol, neu

(ii)mewn perthynas ag anghymhwysedd proffesiynol difrifol a hefyd mewn perthynas ag ymddygiad proffesiynol annerbyniol neu gollfarn am dramgwydd perthnasol;

(b)pan fydd Pwyllgor Cymhwysedd Proffesiynol yn dyfarnu bod athro neu athrawes—

(i)yn euog o anghymhwysedd proffesiynol difrifol, neu

(ii)yn euog o anghymhwysedd proffesiynol difrifol a hefyd yn euog o ymddygiad proffesiynol annerbyniol neu eu bod wedi'u collfarnu o dramgwydd perthnasol,

ystyried a ddylid gwneud gorchymyn disgyblu mewn perthynas â'r athro hwnnw neu'r athrawes honno ac, os ydynt o'r farn y dylid gwneud gorchymyn o'r fath, gwneud gorchymyn o'r fath; ac

(c)penderfynu ar geisiadau o dan reoliad 20 neu 22 neu ar faterion sy'n codi mewn perthynas â gorchmynion disgyblu o dan reoliad 21 neu 23.
