The Secretary of State makes the following Order in exercise of the powers conferred by sections 16(1)(a) and 17 of the Further and Higher Education Act 1992(1) (“the Act”).
In accordance with section 51(3)(a) of the Act, this Order is made for the purpose of giving effect to a proposal for the establishment of a body corporate under section 16(1)(a) of the Act by the Learning and Skills Council for England.
1. This Order may be cited as the Manchester College (Incorporation) Order 2008 and comes into force on 15th February 2008.
2. There shall be established as from 15th February 2008 a body corporate called “the Manchester College”, for the purpose of establishing and conducting as from the operative date a new educational institution of that name.
3. The operative date in relation to the further education corporation established by this Order shall be 1st August 2008, and the corporation shall conduct the Manchester College from that date.

This Order establishes a further education corporation called “the Manchester College” under section 16(1)(a) of the Further and Higher Education Act 1992 for the purpose of conducting the educational institution called by the same name. It appoints 1st August 2008 as the operative date for the purposes of Part 1 of that Act, being the date from which the further education corporation shall operate the college.
An Impact Assessment has not been prepared for this instrument as it has no impact on the costs of business.
