In exercise of the powers conferred on the Secretary of State by sections 218(1)(a), (b), (d), (2), (2A), (2B), (3), (5), and 232(5) and (6) of the Education Reform Act 1988(1) the Secretary of State for Education and Employment hereby makes the following Regulations:

1988 c. 40; section 218 was amended by paragraph 49 of Schedule 8 and Schedule 9 to the Further and Higher Education Act 1992 (c. 13), sections 290 and 291 of the Education Act 1993 (c. 35), section 14 of the Education Act 1994 (c. 30), paragraph 76 of Schedule 37 and Schedule 38 to the Education Act 1996 (c. 56), section 49 of the Education Act 1997 (c. 44), and Schedule 4 to the Teaching and Higher Education Act 1998 (c. 30). Section 218 is prospectively amended by sections 11, 13 and 18 of the Teaching and Higher Education Act 1998, and paragraph 17 of Schedule 30 to the School Standards and Framework Act 1998 (c. 31). Section 232(6) was amended by section 14 of the Education Act 1994 and paragraph 6 of Schedule 3 and Schedule 4 to the Teaching and Higher Education Act 1998.
