The Kent County Council (Wainscott Northern Bypass) Motorway Scheme 1992 Confirmation Instrument 1996

The Secretary of State for Transport makes this Instrument in exercise of powers conferred by sections 16 and 17 of the Highways Act 1980(1), and now vested in him(2), and of all other powers enabling him in that behalf:—

1.  The Kent County Council (Wainscott Northern Bypass) Motorway Scheme 1992 is hereby confirmed without modifications.

2.  The said Scheme as confirmed (hereinafter referred to as “the Scheme”) is set out in the Schedule hereto and copies of the Scheme with its accompanying plan are deposited at the offices of the Department of Transport, 76 Marsham Street, London SW1 3PY and at the offices of the Kent County Council, Director of Legal Services, County Hall, Maidstone, Kent ME14 1XQ.

3.  The Scheme will come into force on the date on which Notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4.  This Instrument may be cited as the Kent County Council (Wainscott Northern Bypass) Motorway Scheme 1992 Confirmation Instrument 1996.

THE SCHEDULEROUTES OF THE CONNECTING ROADS AT THE JUNCTION OF THE M2 MOTORWAY WITH THE PROPOSED WAINSCOTT NORTHERN BYPASS.

1.  A route to connect the southbound carriageway of the Wainscott Northern Bypass with the eastbound carriageway of the M2 Motorway and which has been given the reference number 1 on the deposited plan.

2.  A route to connect the westbound carriageway of the M2 Motorway with the northbound carriageway of the Wainscott Northern Bypass and which has been given the reference number 2 on the deposited plan.

THE SCHEDULETHE HIGHWAYS ACT 1980 THE KENT COUNTY COUNCIL (WAINSCOTT NORTHERN BYPASS) MOTORWAY SCHEME 1992

The Kent County Council make this Scheme in exercise of their powers under Sections 16 and 17 of the Highways Act 1980 and of all other enabling powers:—

1.  The Council are authorised to provide, for the use of traffic of Classes I and II of the classes set out in Schedule 4 to the said Act, as amended:

(a)special roads along the routes described in the Schedule to this Scheme, for the purpose of connecting the M2 Motorway with other highways, at the places stated in the Schedule (these special roads being in this Scheme referred to as “the Connecting Roads”).

2.  The centre lines of the special roads are indicated by heavy black lines on the deposited plan.

3.  In this Scheme:—

“the Council” means The Kent County Council;

“the deposited plan” means the plan numbered 7741/101, marked “The Kent County Council (Wainscott Northern Bypass) Motorway Scheme 1992”, sealed with the Common Seal of the Council, and deposited at the offices of the Council at County Hall, Maidstone, Kent. A certified copy is also deposited at the offices of the Secretary of State for Transport;

“the special roads” means the special roads which the Council are authorised by this Scheme to provide;

“the Motorway” has the meaning given in Article 1 of this Scheme.

4.  This Scheme may be cited as The Kent County Council (Wainscott Northern Bypass) Motorway Scheme 1992.
