The Welsh Ministers in exercise of the powers conferred on the National Assembly for Wales by section 108(2)(b)(iii), (3)(b) and (5) and section 210 of the Education Act 2002(1) and now vested in them(2) and having made such arrangements for consultation as they consider appropriate in accordance with section 117 of the Education Act 2002(3) make the following Order:

Title, commencement and applicationE+W

1.—(1) The title of this Order is the National Curriculum (Educational Programmes for the Foundation Phase and Programmes of Study for the Second and Third Key Stages) (Wales) Order 2013 and it comes into force on 1 September 2013.

(2) This Order applies in relation to Wales.

InterpretationE+W

2.—(1) In this Order—

“the “ar drywydd llythrennedd” document” (“y ddogfen ar drywydd llythrennedd”) means the document published by the Welsh Ministers in January 2013 entitled “Ar drywydd llythrennedd”(4);

“the “literacy — oracy” document” (“y ddogfen literacy — oracy”) means the document published by the Welsh Ministers in January 2013 entitled “Literacy — Oracy across the curriculum”(5);

“the “literacy — reading” document” (“y ddogfen literacy — reading”) means the document published by the Welsh Ministers in January 2013 entitled “Literacy — Reading across the curriculum”(6);

“the “literacy — writing” document” (“y ddogfen literacy — writing”) means the document published by the Welsh Ministers in January 2013 entitled “Literacy — Writing across the curriculum”(7);

“the “llythrennedd — darllen” document” (“y ddogfen llythrennedd — darllen”) means the document published by the Welsh Ministers in January 2013 entitled “Llythrennedd — Darllen ar draws y cwricwlwm”(8);

“the “llythrennedd — llafaredd” document” (“y ddogfen llythrennedd — llafaredd”) means the document published by the Welsh Ministers in January 2013 entitled “Llythrennedd — Llafaredd ar draws y cwricwlwm”(9);

“the “llythrennedd — ysgrifennu” document” (“y ddogfen llythrennedd — ysgrifennu”) means the document published by the Welsh Ministers in January 2013 entitled “Llythrennedd — Ysgrifennu ar draws y cwricwlwm”(10);

“the “numeracy” document” (“y ddogfen rhifedd”) means the document published by the Welsh Ministers in January 2013 entitled “Numeracy”(11);

“the relevant areas of learning” (“y meysydd dysgu perthnasol”) means—

(a)

language, literacy and communication skills; and

(b)

mathematical development;

“the relevant subjects” (“y pynciau perthnasol”) means—

(a)

English;

(b)

Welsh; and

(c)

mathematics;

“the “routes to literacy” document” (“y ddogfen the routes to literacy”) means the document published by the Welsh Ministers in January 2013 entitled “Routes to literacy”(12);

“the “routes to numeracy” document” (“y ddogfen ar drywydd rhifedd”) means the document published by the Welsh Ministers in January 2013 entitled “Routes to numeracy”(13);

“Welsh curriculum” (“y cwricwlwm Cymraeg”) means the curriculum set out in the—

(a)

ar drywydd llythrennedd document;

(b)

llythrennedd — darllen document;

(c)

llythrennedd — llafaredd document; and

(d)

llythrennedd — ysgrifennu document; and

“Welsh-speaking school” (“ysgol Gymraeg”) means a school which follows the Welsh curriculum.

(2) Any references in this Order to the second and third key stages are to be interpreted in accordance with section 103(1)(b) and (c) of the Education Act 2002.

Literacy — oracyE+W

3.—(1) The provisions set out in that part of the llythrennedd — llafaredd document entitled “Y Cyfnod Sylfaen” have effect for the purpose of specifying educational programmes in relation to the relevant areas of learning for Welsh-speaking schools.

(2) For all other schools the provisions set out in that part of the literacy — oracy document entitled “Foundation Phase” have effect for the purpose of specifying educational programmes in relation to the relevant areas of learning.

Explanatory Note

(This note is not part of the Order)

Section 108(2)(b)(iii) and (3) of the Education Act 2002 provides a power for the Welsh Ministers to prescribe by way of an Order educational programmes in respect of the foundation phase and programmes of study in respect of the key stages. The educational programmes and programmes of study set out what pupils must be taught.

The current educational programmes for the areas of learning in the foundation phase were given legal effect by the Education (National Curriculum) (Foundation Stage) (Wales) Order 2008. The current programmes of study for the subjects in the second, third and fourth key stages were given legal effect by the Education (National Curriculum) (Attainment Targets and Programmes of Study) (Wales) Order 2008.

This Order gives legal effect to additional educational programmes for the language, literacy and communication skills and mathematical development areas of learning in the foundation phase (Part 1 of the Order).

This Order also gives legal effect to the additional programmes of study in English, Welsh and mathematics in the second and third key stages (Part 2 of the Order).

The functions of the National Assembly for Wales in the sections in the Education Act 2002 were transferred to the Welsh Ministers under paragraph 30 of Schedule 11 to the Government of Wales Act 2006.
