Penderfynu atebolrwydd i adfer
18.—(1) Os bydd yr awdurdod gorfodi'n penderfynu bod y difrod yn ddifrod amgylcheddol, rhaid iddo hysbysu gweithredwr neu weithredwyr unrhyw weithgaredd neu weithgareddau a achosodd y difrod (gweithredwr y cyfeirir ato yn y Rheoliadau hyn fel “y gweithredwr cyfrifol” (“the responsible operator”))—
(a)bod y difrod yn ddifrod amgylcheddol;
(b)bod gweithgaredd y gweithredwr cyfrifol yn un o achosion y difrod amgylcheddol;
(c)bod rhaid i'r gweithredwr cyfrifol gyflwyno cynigion, o fewn amser a bennir gan yr awdurdod gorfodi, ar gyfer mesurau a fyddai'n sicrhau adferiad i gywiro'r difrod amgylcheddol yn unol ag Atodlen 4; ac
(ch)bod gan y gweithredwr cyfrifol hawl i apelio.
(2) Caiff yr awdurdod gorfodi dynnu'r hysbysiad yn ôl neu ei amrywio os yw wedi'i fodloni na ddylai'r hysbysiad fod wedi'i gyflwyno neu fod apêl yn erbyn yr hysbysiad yn debyg o lwyddo.
