Mae Gweinidogion Cymru, gan eu bod wedi eu dynodi(1) at ddibenion adran 2(2) o Ddeddf y Cymunedau Ewropeaidd 1972(2) yn gwneud y Rheoliadau hyn o dan y pwerau a roddwyd gan yr adran honno fel y'i darllenir gyda pharagraff 1A o Atodlen 2 i'r Ddeddf honno.

Mae'r Rheoliadau yn gwneud darpariaeth at ddiben a grybwyllir yn adran 2(2) o Ddeddf y Cymunedau Ewropeaidd 1972 a pharagraff 1A o Atodlen 2 iddi, ac mae'n ymddangos i Weinidogion Cymru ei bod yn hwylus i'r offerynnau Cymunedol y cyfeirir atynt yn y Rheoliadau hyn gael eu dehongli fel cyfeiriadau at yr offerynnau hynny fel y'u diwygir o dro i dro.

Mae'r dynodiadau perthnasol wedi'u rhoi gan O.S. 2002/248 fel y'i diwygiwyd gan O.S. 2000/3329 (mesurau sy'n ymwneud â chadwraeth cynefinoedd naturiol a ffawna a fflora gwyllt); O.S. 2003/2901, fel y'i diwygiwyd gan O.S. 2006/3329 (mesurau sy'n ymwneud ag adnoddau dŵr a mesurau sy'n ymwneud â rheoli a rheoleiddio gollwng organeddau a addaswyd yn enetig yn fwriadol, eu rhoi ar y farchnad a'u symud ar draws ffiniau); O.S. 2005/850 fel y'i diwygiwyd gan O.S. 2006/3329 (mesurau sy'n ymwneud ag atal, lleihau a dileu llygredd a achosir gan wastraff a rheoli pecynnu a gwastraff pecynnu a mesurau sy'n ymwneud ag atal a chyfyngu ar effeithiau damweiniau sy'n cynnwys sylweddau peryglus i'r graddau y maent yn ymwneud â pholisïau a chaniatadau cynllunio defnydd tir); ac O.S. 2007/193 (mesurau sy'n ymwneud ag atal a chywiro halogiad tir).
