1. The title of these Regulations is the Education (Information About Individual Pupils) (Wales) (Amendment) Regulations 2006 and they come into force on 11 January 2006.
2.—(1) The Education (Information About Individual Pupils) (Wales) Regulations 2003(3) are amended as follows.
(2) In regulation 2, in the appropriate place in alphabetical order insert the following new definitions—
““school” (“ysgol”) means a school maintained by a local education authority, but does not include a pupil referral unit;
“school year” (“blwyddyn ysgol”) means the period beginning with the first school term to begin after July and ending with the beginning of the first such term to begin after the following July;”.
(3) In regulation 2, for the definition of “sixth form pupil” substitute—
““sixth form pupil” (“disgybl chweched dosbarth”) means a pupil at a school who is in receipt of education suitable to the requirements of pupils above compulsory school age;”.
(4) In Part 1 of the Schedule, in paragraph 5, omit “and, if so, with whom”.
(5) In Part 2 of the Schedule, in paragraph 1 for “sixth form pupil at the school” substitute “person who is, or was at any previous time during the school year in which the request for the information was made, a pupil in the school’s sixth form”.
(6) In Part 2 of the Schedule, in paragraph 1(c) after “beginning” insert “and end”.

These Regulations make minor amendments to the Education (Information About Individual Pupils) (Wales) Regulations 2003 (“the 2003 Regulations”) by—
(a)adding a new definitions of “school”, substituting a new definition of “sixth form pupil”, and adding a new definition of “school year”;
(b)slightly altering the wording of paragraph 5 of Part 1 of the Schedule to the 2003 Regulations so that the governing body of a school will no longer be required to specify with whom a pupil speaks Welsh at home;
(c)altering the wording of paragraph 1 of Part 2 of that Schedule so that information which the governing body may be required to provide about sixth form pupils can include information about pupils who have left the school during the course of the school year; and
(d)slightly altering the wording of paragraph 21(c) of that Part so that the information which may be required about pupils' basic skills needs for literacy and numeracy will now include pupils' needs at the end, as well as at the beginning, of their learning activities programme.
1996 c. 56. Section 537A was inserted by the Education Act 1997 (c. 44), section 20, and substituted by the School Standards and Framework Act 1998 (c. 31), section 140(1) and Schedule 30, paragraphs 57 and 153. For the meaning of “prescribed” and “regulations” see section 579(1) of the 1996 Act.
