Esemptiadau rhag y gofyniad i sefydlu gorchudd glas ar neilltir

7.—(1) Ym mhob cae neu ran o gae y mae unrhyw un o'r opsiynau a grybwyllir ym mharagraff 1(1) neu (2) yn cael ei weithredu, bydd ffermwr yn rhinwedd y ddarpariaeth hon yn cael ei drin fel un sy'n esempt rhag gofyniad i sefydlu gorchudd glas erbyn dechrau'r tymor gorchudd glas cyfredol, os yw'n bodloni'r Cynulliad Cenedlaethol nad oedd yn ymarferol sefydlu gorchudd glas erbyn hynny am resymau hinsoddol, ac, os yw'n cael ei drin fel un sy'n esempt, rhaid iddo sefydlu gorchudd glas cyn gynted ag y bo'n rhesymol bosibl ar ôl dechrau'r tymor gorchudd glas.

(2) Ym mhob cae neu ran o gae y gweithredir unrhyw un o'r opsiynau a grybwyllir ym mharagraff 1(1) neu (2), nid oes rhaid i ffermwr sefydlu gorchudd glas ar lain o dir sy'n rhan o'r tir sydd wedi;'i neilltuo ac sy'n ffinio â'i ymyl, a honno'n llain hyd at —

(a)1 metr o led, pan fo'r llain o dir sydd wedi'i neilltuo yn ffinio â thir a blannwyd â chnwd nad yw'n gnwd hadau;

(b)2 fetr o led, pan fo'r llain o dir sydd wedi'i neilltuo yn ffinio â thir a blannwyd â chnwd hadau; neu

(c)5 metr, mewn unrhyw fan lle gall fod yn bosibl i gerbydau fynd ar y tir hwnnw o ffordd neu drac sy'n gyfagos â'r tir hwnnw, ar yr amod bod y llain yn cael ei haredig a'i gadael yn fraenar.

(3) Yn is-baragraff (2), ystyr “cnwd hadau” yw cnwd a dyfir fel bod modd cynaeafu hadau'r cnwd a'u hau i sefydlu cnwd pellach.
