Esemptiadau rhag y gofyniad i gynnal a chadw gorchudd glas ar y tir sydd wedi'i neilltuo oddi wrth waith cynhyrchu

8.—(1) Ym mhob cae neu ran o gae y gweithredir unrhyw un o'r opsiynau a grybwyllir ym mharagraff 1(1) neu (2), nid yw'n ofynnol i ffermwr gynnal a chadw gorchudd glas ar y tir sydd wedi'i neilltuo oddi wrth waith cynhyrchu pan fo'r gorchudd glas hwnnw wedi'i ddifa ar ôl taenu plaleiddiad ar y tir ar neu ar ôl 15 Ebrill yn y flwyddyn gyfredol.

(2) Ar gyfer pob cae neu ran o gae y mae unrhyw un o'r opsiynau a grybwyllir ym mharagraff 1(1) neu (2), bydd ffermwr yn cael ei drin yn rhinwedd y ddarpariaeth hon fel un sy'n esempt rhag gofyniad i gynnal a chadw gorchudd glas os yw'n bodloni'r Cynulliad Cenedlaethol bod y gorchudd glas a sefydlodd wedi methu neu nad oedd modd iddo atal yn rhesymol y methiant hwnnw.

(3) Bydd yr esemptiadau a grybwyllwyd yn is-baragraffau (1) a (2) yn gymwys —

(a)yn achos yr esemptiad yn is-baragraff (1), tan ddechrau tymor canlynol y gorchudd glas; a

(b)yn achos yr esemptiad yn is-baragraff (2), tan ddiwedd y flwyddyn gyfredol.

(4) Ym mhob cae neu ran o gae y gweithredir unrhyw un o'r opsiynau a grybwyllir ym mharagraff 1(1) neu (2), a lle mae ffermwr wedi dewis peidio â sefydlu gorchudd glas ar lain o dir yn unol â pharagraff 7(2), nid oes rhaid iddo gynnal a chadw unrhyw orchudd glas sydd wedyn yn ymsefydlu ar y llain honno.
