The Secretary of State, in exercise of the powers conferred by section 128 of the Serious Organised Crime and Police Act 2005(1), makes the following Order:
1.—(1) This Order may be cited as the Serious Organised Crime and Police Act 2005 (Designated Sites) (Amendment) Order 2020 and comes into force on 31st January 2020.
(2) Subject to paragraph (3), this Order extends to England and Wales and Northern Ireland.
(3) Article 3 extends to England and Wales only.
2.—(1) The Serious Organised Crime and Police Act 2005 (Designated Sites) Order 2005(2) is amended as follows.
(2) In the Schedule—
(a)in the appropriate places insert—
(i)“Defence Science and Technology Laboratory, Porton Down”;
(ii)“RAF Molesworth”;
(iii)“RAF Waddington”;
(b)omit “Sea Mounting Centre Marchwood”.
3.—(1) The Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) Order 2007(3) is amended as follows.
(2) In article 2(1), omit sub-paragraph (d).

This Order designates the following sites for the purposes of section 128 of the Serious Organised Crime and Police Act 2005 (“the 2005 Act”): Defence Science and Technology Laboratory, Porton Down, RAF Molesworth and RAF Waddington. A person who enters on the sites designated in this Order as a trespasser commits an offence under section 128(1) of that Act.
This Order also revokes the designation in respect of 2 sites previously designated under section 128 of the 2005 Act. These are: the Old War Office in London and the Sea Mounting Centre Marchwood in Southampton.
2005 c. 15; section 128 was amended by section 12 of the Terrorism Act 2006 (c. 11).
S.I. 2007/930, to which there are amendments not relevant to this Order.
