The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 51(4)(c) and (5) and 135(2) of the Children and Families Act 2014(1).
1. These Regulations may be cited as the Special Educational Needs and Disability (First-tier Tribunal Recommendation Power) (Pilot) (Amendment) Regulations 2016 and come into force on 1st February 2016.
2. The Special Educational Needs and Disability (First-tier Tribunal Recommendation Power) (Pilot) Regulations 2015(2) are amended by inserting the following into the Schedule (Pilot Local Authorities) to those Regulations at the appropriate places in the alphabetical order—
“Birmingham City Council.”;
“Buckinghamshire County Council.”;
“East Sussex County Council.”;
“Northamptonshire County Council.”.

These Regulations amend the Special Educational Needs and Disability (First-tier Tribunal Recommendation Power) (Pilot) Regulations 2015 by adding four additional local authorities to the list of pilot local authorities in the Schedule to those Regulations. This will enable the additional local authorities (Birmingham City Council, Buckinghamshire County Council, East Sussex County Council and Northamptonshire County Council) to participate in the pilot scheme.
