Coming into force in accordance with article 1

This Order is made in exercise of the powers conferred by sections 87(3)(a) and (b) and (5) and 210(7) of the Education Act 2002(1).

In accordance with section 96(2), (3) and (4) of that Act, the Secretary of State for Education gave notice of the proposal to the bodies and persons mentioned in those subsections and gave them a reasonable opportunity of submitting evidence and representations as to the issues arising.

In accordance with section 96(5), the Secretary of State published a draft of the proposed order and the associated documents, and a summary of the views expressed.

In accordance with section 96(6), the Secretary of State allowed a period of not less than one month beginning with the publication of the draft of the proposed order for the submission of further evidence and representations as to the issues arising.

The Secretary of State now makes the following Order.

Citation and commencement

1.—(1) This Order may be cited as the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England)(Amendment)(No. 2) Order 2014 and, subject to paragraph (2), comes into force on 1st September 2014.

(2) Article 3(a) comes into force on 1st August 2015.

Amendments to the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) Order 2013

2.  The Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) Order 2013(2) is amended as follows.

3.  Article 2 is amended as follows—

(a)in paragraph (a) for the words “11th September 2013” substitute “16th July 2014”; and

(b)for paragraph (b) substitute—

(b)“the P Scale Document” means the document published by the Department for Education on 16th July 2014 entitled “Performance – P Scale – attainment targets for pupils with special educational needs who are working at a level set out in this Document in relation to a core or other foundation subject”..

4.  After article 3(4) insert—

(5) In relation to any pupil who is in the first year of the fourth key stage on or after 1st August 2015 but before 1st August 2016, it is directed that the provisions relating to programmes of study set out in the Framework Document have effect for the purposes of specifying the programme of study for the fourth key stage in relation to English and mathematics.

(6) In relation to any pupil who is in the fourth key stage on or after 1st August 2016, it is directed that the provisions relating to programmes of study set out in the Framework Document have effect for the purposes of specifying the programme of study for the fourth key stage in relation to English and mathematics..

5.  In article 5 for the words “P Level” substitute “P Scale” wherever they appear.

6.  For article 6(3) substitute—

(3) The Education (National Curriculum)(Attainment Targets and Programmes of Study in English in respect of the Third and Fourth Key Stages)(England) Order 2008(3) and the Education (National Curriculum)(Attainment Targets and Programmes of Study in Mathematics in respect of the Third and Fourth Key Stages)(England) Order 2008(4) continue to have effect in relation to any pupil who—

(a)is in the fourth key stage before 1st August 2015 for the purposes of specifying the programme of study for the fourth key stage in relation to English and mathematics; or

(b)is in the final year of the fourth key stage on or after 1st August 2015 but before 1st August 2016 for the purposes of specifying the programme of study for the fourth key stage in relation to English and mathematics..

Revocation of the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) (Amendment) Order 2014

7.  The Education (National Curriculum)(Attainment Targets and Programmes of Study)(England)(Amendment) Order 2014(5) is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) Order 2013, which makes provision for a new National Curriculum from 2014 by giving effect to the Framework Document.

It gives effect to a revised Framework Document (from 2015), with new key stage 4 programmes of study for English and mathematics that will apply to year 10 pupils in 2015-16 and to all pupils in key stage 4 from 2016 onwards. It also provides that those Orders which contain the current key stage 4 programmes of study for English and mathematics will continue to apply to all pupils in key stage 4 up to 2015, and to year 11 pupils only in 2015-16.

The Order also gives effect to a P Scale Document.

The Order also revokes the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England)(Amendment) Order 2014.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
