The Secretary of State, in exercise of the powers conferred by sections 26(2)(c) and (4)(a) and 36(2)(a) of the Horserace Betting and Olympic Lottery Act 2004(1), makes the following Regulations:
1. These Regulations may be cited as the Olympic Lotteries (Payments out of the Olympic Lottery Distribution Fund) Regulations 2014 and shall come into force on 22nd July 2014.
2.—(1) The Secretary of State may make a payment of £79,000,000 from the Olympic Lottery Distribution Fund into the National Lottery Distribution Fund on or after 22nd July 2014.
(2) Any payment made under paragraph (1) is to be treated as having been paid into the National Lottery Distribution Fund by virtue of section 5(6)(2) of the National Lottery etc. Act 1993(3) (general payments into fund).

These Regulations permit the Secretary of State to make a payment of £79,000,000 from the Olympic Lottery Distribution Fund into the National Lottery Distribution Fund, on or after 22nd July 2014.
Article 2(1) allows the payment. Article 2(2) specifies that the payment is to be treated as having been paid into the National Lottery Distribution Fund by virtue of section 5(6) of the National Lottery etc. Act 1993. This results in the payment being apportioned within the National Lottery Distribution Fund as provided in section 22 of the National Lottery etc. Act 1993.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum has been prepared and is available alongside this instrument on the website, www.legislation.gov.uk.
2004 c. 25. Sections 26(2) and 26(4) were amended by S.I. 2007/2129 and S.I. 2010/1551. Section 26(4)(a) is to be amended by Schedule 1 of the National Lottery Act 2006 (c. 23), but an order under section 6(1) of that Act bringing Schedule 1 into force has not yet been made.
Section 5(6) of the 1993 Act was amended by section 34(1) and (3) of the 2004 Act. Section 5 is to be replaced under amendments made by Schedule 1 of the National Lottery Act 2006, but an order under section 6(1) of that Act bringing Schedule 1 into effect has not yet been made.
