The Secretary of State makes the following Order in exercise of the powers conferred by section 14(2) of the Football Spectators Act 1989(1) (having regard to the definition of “prescribed” in section 22A).

Citation and commencement

1.  This Order may be cited as the Football Spectators (Prescription) (Amendment) Order 2013 and shall come into force on 2nd August 2013.

Amendments to the Football Spectators (Prescription) Order 2004

2.—(1) The Football Spectators (Prescription) Order 2004(2) is amended as follows.

(2) In article 3(2)(a) for “, the Scottish Premier League or the Scottish Football League” substitute “or the Scottish Professional Football League”.

(3) In article 3(2)(b) omit “for the time being”.

(4) In article 4(2)(b) for “, the Scottish Premier League or the Scottish Football League” substitute “or the Scottish Professional Football League”.

(5) Omit article 4(2)(e) and the word “or” immediately preceding it.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Football Spectators (Prescription) Order 2004 to amend the definition of association football match within the regulated football match provisions of Part II of the Football Spectators Act 1989.

The Order substitutes a reference to the Scottish Professional Football League for the Scottish Football League and the Scottish Premier League, following the merger of the two latter leagues to form one body. The Order also clarifies that an association football match is a regulated football match where the match involves clubs whose home grounds are outside England or Wales but they are playing within England or Wales. Finally, the Order deletes a historic reference to matches played as part of the 2012 Olympics.

1989 c. 37. Section 14 was substituted by section 1 of, and paragraphs 1 and 2 to, the Football (Disorder) Act 2000 (c. 25) and amended by section 103 of the Policing and Crime Act 2009 (c. 26). Section 22A was inserted by paragraph 18 of Schedule 2 to the Football (Disorder) Act 2000 and amended by paragraph 1 of Schedule 5 to the Violent Crime Reduction Act 2006 (c. 38) and paragraph 5 of Schedule 1 to the Identity Documents Act 2010 (c. 40).
