The Secretary of State makes the following Order in exercise of the power conferred by section 8B(5) of the Immigration Act 1971(1).

1.  This Order may be cited as the Immigration (Designation of Travel Bans) (Amendment No. 3) Order 2012 and shall come into force on 7th December 2012.

2.—(1) Part 2 of the Schedule to the Immigration (Designation of Travel Bans) Order 2000(2) is amended as follows.

(2) For the paragraph beginning “Council Decision 2010/639/CFSP of 25 October 2010 (Belarus)” substitute “Council Decision 2012/642/CFSP of 15 October 2012 (Belarus)(3).”.

(3) After “Council Decision 2012/285/CFSP of 31 May 2012 (Republic of Guinea-Bissau)” insert “as implemented by Council Implementing Decision 2012/516/CFSP of 24 September 2012 (Republic of Guinea-Bissau)(4)”.

(4) After “as amended by Council Decision 2012/457/CFSP of 2 August 2012 (Iran)” insert “and as amended by Council Decision 2012/635/CFSP of 15 October 2012 (Iran)(5)”.

(5) After “as amended by Council Decision 2012/170/CFSP of 23 March 2012 (Republic of Moldova)” insert “and as amended by Council Decision 2012/527/CFSP of 27 September 2012 (Republic of Moldova)(6)”.

(6) After “as amended by Council Decision 2012/388/CFSP of 16 July 2012 (Somalia)” insert “and as amended by Council Decision 2012/633/CFSP of 15 October 2012 (Somalia)(7)”.

(7) For the paragraph beginning “Council Decision 2011/782/CFSP of 1 December 2011 (Syria)” substitute “Council Decision 2012/739/CFSP of 29 November 2012 (Syria)(8).”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Schedule to the Immigration (Designation of Travel Bans) Order 2000.

It amends Part 2 of that Schedule to list: Council Decision 2012/642/CFSP of 15 October 2012 (Belarus) (which replaced Council Decision 2010/639/CFSP of 25 October 2010 (Belarus) and all the subsequent amending and implementing Council Decisions); Council Implementing Decision 2012/516/CFSP of 24 September 2012 (Republic of Guinea-Bissau); Council Decision 2012/635/CFSP of 15 October 2012 (Iran); Council Decision 2012/527/CFSP of 27 September 2012 (Republic of Moldova); Council Decision 2012/633/CFSP of 15 October 2012 (Somalia); and Council Decision 2012/739/CFSP of 29 November 2012 (Syria) (which replaced Council Decision 2011/782/CFSP of 1 December 2011 (Syria) and all the subsequent amending and implementing Council Decisions).

Any person named by or under an instrument listed in the Schedule (as amended) or falling within a description specified in such an instrument will be excluded from the United Kingdom (subject to the exceptions specified in article 3 of the 2000 Order).

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
