The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 9(3), 11 and 123 of the Local Government Act 2003(1):

Citation, commencement and application

1.—(1) These Regulations may be cited as the Local Authorities (Capital Finance and Accounting) (England) (Amendment) (No.3) Regulations 2012.

(2) These Regulations shall come into force on 14th June 2012 and apply only in relation to local authorities in England.

Amendment of Regulations

2.  The Local Authorities (Capital Finance and Accounting) (England) Regulations 2003(2) are amended as specified in regulations 3 and 4.

Correction of definition

3.  In regulation 1(5), in the definition of “affordable housing” and “provision of affordable housing” replace “regulation 17” with “regulation 18”.

Schedule – Calculation of the sub-liability

4.  In the Schedule—

(a)omit the names of the authorities and Column A (assumed debt for each quarter in a year) in the Table; and

(b)insert the names of the authorities and Column A (assumed debt for each quarter in a year) set out in the Schedule to these Regulations.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Local Authorities (Capital Finance and Accounting) (England) Regulations 2003 (“the 2003 Regulations”) by amending the definition of “affordable housing” and substituting the names of the authorities and the values of Column A (assumed debt for each quarter) in the Table in the Schedule to the 2003 Regulations with names of the authorities and the values set out in the Schedule to these Regulations.

S.I. 2003/3146 as amended by S.I. 2006/521, S.I. 2007/573, S.I. 2012/265 and S.I. 2012/ 711. There are other amending instruments but none is relevant to these Regulations.
