The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by paragraph 5(1) of Schedule 7 to the Traffic Management Act 2004(1).
The Secretary of State has carried out the consultation required by paragraph 5(3) of that Schedule.
1. These Regulations may be cited as the Traffic Management Act 2004 (Amendment of Schedule 7) (City of Exeter) Regulations 2012 and come into force on 30th January 2012.
2. In Schedule 7 to the Traffic Management Act 2004 (road traffic contraventions subject to civil enforcement), in paragraph 4 (parking contraventions outside Greater London), after sub-paragraph (2)(e) insert—
“(ea)an offence under section 30(1) of the Exeter City Council Act 1987 (c. xi) (prohibition of parking vehicles on verges, central reservations and footways).”(2)

Schedule 7 to the Traffic Management Act 2004 specifies the road traffic contraventions that are subject to civil enforcement by way of penalty charges.
These Regulations amend paragraph 4 of that Schedule (parking contraventions outside Greater London) by adding to the list of such contraventions the offence under section 30(1) of the Exeter City Council Act 1987 of parking vehicles, other than certain heavy commercial vehicles, on verges, central reservations and footways.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
2004 c.18; section 92 provides that the Secretary of State is the “appropriate national authority” as regards England for the purposes of Part 6 of the Act.
Section 30 applies from the appointed day, which was 11th June 1990 by virtue of a resolution of Exeter City Council dated 4th May 1990 and made pursuant to section 3 of the Exeter City Council Act 1987.
