The Secretary of State makes the following Order in exercise of the powers conferred by section 4(3) of the Holocaust (Return of Cultural Objects) Act 2009(1).
In accordance with section 4(5) of that Act the Secretary of State has consulted the Scottish Ministers.
1. This Order may be cited as the Holocaust (Return of Cultural Objects) Act 2009 (Commencement) Order 2010.
2. The day appointed for the purposes of section 4(3) of the Holocaust (Return of Cultural Objects) Act 2009 (Commencement) is 13th January 2010.

This Order brings into force the provisions of the Holocaust (Return of Cultural Objects) Act 2009, on 13th January 2010.
The Act enables particular bodies listed in the Act to transfer cultural objects from their collections, in certain circumstances relating to events during the Nazi era (1st January 1933 to 31st December 1945), subject to two conditions being satisfied. (Such transfers would otherwise be prevented by provisions in the governing statutes of these bodies.)
The first condition is that an Advisory Panel, designated by the Secretary of State, has recommended the transfer of the cultural object. The second condition is that the Secretary of State has approved the Advisory Panel’s recommendation.
The Secretary of State may approve a recommendation for the transfer of an object from the collections of a Scottish body only with the consent of the Scottish Ministers.
