The Secretary of State makes the following Order in exercise of the powers conferred by section 17(4) of the Crime and Disorder Act 1998(1).
In accordance with section 114(3)(2) of that Act a draft of this Order was laid before Parliament and approved by a resolution of each House of Parliament.
1. This Order may be cited as the Crime and Disorder Act 1998 (Additional Authorities) Order 2008 and shall come into force one month after the day on which it is made.
2. In section 17(2) of the Crime and Disorder Act 1998(3) (duty to consider crime and disorder implications), at the end of subsection (2) (authorities to which the duty applies) there is inserted —
“the Greater London Authority(4);
the London Development Agency(5).
Transport for London(6).”.

This Order amends the list of authorities in section 17(2) of the Crime and Disorder Act 1998 to which the duty in section 17(1) applies. The duty in section 17(1) is a duty to exercise functions with regard to the likely effect of those functions on, and the need to do all that a body or person reasonably can to prevent, crime and disorder (including anti-social behaviour and behaviour adversely affecting the local environment) in the area and the misuse of drugs, alcohol and other substances in the area. The bodies added are the Greater London Authority, the London Development Agency and Transport for London.
1998 c. 37; section 17(4) was inserted by paragraph 4 of Schedule 9 to the Police and Justice Act 2006 (c.48).
Section 114(3) was amended by paragraph 6 of Schedule 9 to the Police and Justice Act 2006. There are other amendments to section 114 of the 1998 Act not relevant to this Order.
Section 17(2) was substituted by paragraph 3 of Schedule 9 to the Police and Justice Act 2006.
The Greater London Authority is established under Part 1 of the Greater London Authority Act 1999 (c.29).
The London Development Agency is established under Part I of the Regional Development Agencies Act 1998 (c.45) as amended by Part V of the Greater London Authority Act 1999.
Transport for London is established under Part IV of the Greater London Authority Act 1999.
