The Secretary of State, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the control of the export of goods and measures relating to trade in dual use items, including the transmission of software and technology in intangible form, in the exercise of the powers conferred on her by that section, hereby makes the following Regulations:
1.—(1) These Regulations may be cited as The Dual-Use Items (Export Control) (Amendment) Regulations 2002 and shall come into force on 5th February 2002.
(2) In this Regulation the “principal Regulations” are the Dual-Use Items (Export Control) Regulations 2000(3).
2. Regulation 2(1) of the principal Regulations providing for the definition of “the Regulation” is amended by deleting “as amended by Council Regulation (EC) No. 2889/2000 of 22 December 2000(4) and Council Regulation (EC) No. 458/2001 of 6 March 2001(5)” and substituting the following:
“as amended by the Council Regulations listed in Schedule 1A”
3. Insert after Schedule 1 to the principal Regulations a new Schedule 1A as follows:
Regulation 2
Council Regulation (EC) No. 2889/2000 of 22 December 2000(6).
Council Regulation (EC) No. 458/2001 of 6 March 2001(7).
Council Regulation (EC) No. 2432/2001 of 20 November 2001(8).”
4. Schedule 2 of the principal Regulations is amended by deleting entries IC950 and IE950.

The Dual-Use Items (Export Control) Regulations 2000 (S.I. 2000/2620) were made in implementation of and pursuant to Council Regulation (EC) No. 1334/2000 setting up a community regime for the control of exports of dual-use items and technology. (O.J. L 159, 30.06.00, p.1.)
These Regulations make the following changes to the Dual-Use Items (Export Control) Regulations 2000:
(a)Extending the definition of “the Regulation” to include Council Regulation (EC) 2432/2001 of 20 November 2001 (O.J. No. L 338, of 20/12/01 p.1);
(b)Creating a new Schedule 1A to list amendments to Council Regulation (EC) No. 1334/2000; and
(c)Removing the general prohibition on exportation to any destination except Member States of Materials and Technology covered by 1C950 and 1E950 respectively. These items are now included in Annex 1 of Council Regulation (EC) No. 1334/2000.
