The Secretary of State, in exercise of the powers conferred on him by sections 1(1) and (2) and 24(1) and (3) of the Food and Environment Protection Act 1985(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Partial Revocation Order 1999 and shall come into force on 20th January 1999.

(2) In this Order, “the principal Order” means the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Order 1991(2).

Partial revocation

2.—(1) The principal Order is revoked so far as it designates any part of the areas set out in Schedule 1 to this Order.

(2) Part II of Schedule 1 to the principal Order shall be amended in accordance with Schedule 2 to this Order.

SCHEDULE 1

Strathclyde Region

The area of land within the former Cumnock and Doon Valley District, now East Ayrshire Council area, comprising that part of the Parish of Muirkirk bounded as follows:-

  • On the north from the summit of Bibblon Hill at point national grid reference NS665324 in an easterly direction following the boundary between East Ayrshire Council area and South Lanarkshire Council area to the point national grid reference NS718342; then in a south westerly direction to point national grid reference NS711320; then continuing in a south westerly direction to point national grid reference NS705315; then in a southerly direction to point national grid reference NS705310; then in a south-westerly direction to the Road A723 at point national grid reference NS697307; then in a northerly direction following the line of the said Road to spot height 297; then in a westerly direction to spot height 466 on Middlefield Law; then continuing in a westerly direction to point national grid reference NS665304; then in a northerly direction to point national grid reference NS663315; then in a northerly direction to the summit of Bibblon Hill at point national grid reference NS665324.

SCHEDULE 2

Strathlcyde Region

1.  For paragraph 2(c) of Part II of Schedule 1 to the principal Order there shall be substituted the following:–

(c)The area of land within the former Cumnock and Doon Valley District, now East Ayrshire Council area, comprising that part of the Parish of Auchinleck bounded as follows:–

  • On the north on the boundary between the Parishes of Muirkirk and Auchinleck at spot height 418 at point national grid reference NS675224; then in an easterly direction along said boundary until it meets the western boundary of Drummond’s Knowe Plantation; then following the western boundary of the said Plantation in a south-westerly direction until it meets the boundary between the Parishes of Auchinleck and New Cumnock; then in a westerly direction along the said boundary to point national grid reference NS697180; then in a north-westerly direction to point national grid reference NS695184; then in a westerly direction to the summit of Black Hill at spot height 428 then in a westerly direction to the summit of Benalt at spot height 381; then in a north-westerly direction to point national grid reference NS668190; then in a northerly direction to point national grid reference NS668197 on Glenmuir Water; then in a generally westerly direction following the south bank of Glenmuir Water to its point of intersection with the boundary between the Parishes of Auchinleck and Old Cumnock west of Dalblair at point national grid reference NS643193; then in a northerly direction to the point national grid reference NS643194 on the Dornal Burn; then in a generally northerly direction following the line of the Dornal Burn to the point national grid reference NS655208; then in a northerly direction to the south bank of Gass Water at point national grid reference NS656212; then in a north-westerly direction following the said Gass Water to the point national grid reference NS646224; then in a north-easterly direction to point national grid reference NS650225; then in an easterly direction to spot height 418 at point national grid reference NS675224..

Central Region

2.  For paragraph 3(a) of Part II of Schedule 1 to the principal Order there shall be substituted the following:–

For those areas of land within the former Stirling District, now Stirling Council area, comprising those parts of the Parish of Killin bounded as follows:–

(i)On the north from point national grid reference NN509369 on the River Lochay in south-easterly direction along the said River to point national grid reference NN537355; then in a south-westerly direction by the western bank of Lochan nan Damh to point national grid reference NN520330; then in an easterly direction to the summit of Meall Clachach at spot height 603; then in a generally easterly and southerly direction to the boundary of the Monemore Plantation at point national grid reference NN556325; then in a generally south-easterly direction following the boundary of the said Plantation to its southernmost point; then in a south-easterly direction to the River Dochart; then in a south-westerly direction, following the line of the said River Dochart to point of intersection with the Allt Riobain Burn at point national grid reference NN452278; then in a northerly direction following said Burn to point national grid reference NN454322; then in a north-easterly direction to the summit of Meall a Churain at spot height 917; then in a north-easterly direction to the summit at spot height 881; then in an easterly direction to the summit at spot height 864; then in a south-easterly direction to the summit at spot height 766; then generally in a northerly direction to and by the Allt Dubhchlair Burn until it meets the River Lochay at point national grid reference NN509369.

(ii)on the north from point national grid reference NN509285 on the Road A85 in a north-easterly and south-easterly direction following the line of said Road, to the point of intersection with the boundary between the Parishes of Killin and Balquhidder at point national grid NN564276; then in a south-westerly direction by said boundary to point national grid reference NN522250; then in a generally northerly direction to the summit of Creag Ghlas at spot height 593; then in a northerly direction to the unnamed Burn at point national grid reference NN523272; then following the unnamed Burn in a northerly direction to the point of interception with the Road A85 at point national grid reference NN509285..

Explanatory Note

(This note is not part of the Order)

This Order partially revokes the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Order 1991 which contains emergency prohibitions restricting various activities in order to prevent human consumption of food which has been, or which may have been, rendered unsuitable for that purpose in consequence of the escape of radioactive substances from a nuclear reactor situated at Chernobyl in the Ukraine.

This Order reduces the area subject to restriction.

1985 c. 48; section 1 was amended by section 51 of the Food Safety Act 1990 (c. 16). Section 1(2) defines “designating authority” and section 24(1) contains a definition of “the Ministers” relevant to the exercise of the statutory powers under which this Order is made.
