In exercise of the powers conferred on the Secretary of State by section 144(1) and (2)(f) of the School Standards and Framework Act 1998(1), the Secretary of State for Education and Employment hereby makes the following Regulations:–
1. These Regulations may be cited as the School Standards and Framework Act 1998 (School Playing Fields) (Modification) (England) Regulations 1999 and shall come into force on 1st February 1999.
2. Until Schedule 22 to the School Standards and Framework Act 1998 comes into force, section 77(2)(b) of that Act shall have effect with the modification that for “either of paragraphs 1 and 2 of Schedule 22” there shall be substituted “section 231(7) of the Education Act 1996(2)”.

Section 77(2)(b) of the School Standards and Framework Act 1998 which is proposed to come into force on 1st February 1999, contains a reference to paragraphs 1 and 2 of Schedule 22 to that Act (which, amongst other things, makes provision for the consent of the Secretary of State to the disposal of land by governing bodies of certain schools). Schedule 22 is not expected to come into force until 1st September 1999 and these regulations provide that until then, section 77 has effect with modifications.
1996 c. 56; section 231 applies with modifications to grant-maintained special schools by virtue of paragraph 12 of Schedule 28 and regulation 16 of S.I. 1994/653.
