CHANGES IN LOCAL GOVERNMENT AREAS

The Kensington and Chelsea and Westminster (London Borough Boundaries) Order 1993

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement

1.—(1) This Order may be cited as the Kensington and Chelsea and Westminster (London Borough Boundaries) Order 1993.

(2) This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976(2).

(3) For all other purposes, this Order shall come into force on 1st April 1994.

Interpretation

2.—(1) In this Order—

“the map” means the map prepared by the Department of the Environment, marked “Map of the Kensington and Chelsea and Westminster (London Borough Boundaries) Order 1993”, duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

“the Royal Borough” means the Royal Borough of Kensington and Chelsea in Greater London; any reference to a ward is a reference to a ward of the borough or city from or to which an area is transferred; and

“Westminster” means the city of Westminster in Greater London.

Transfers from the Royal Borough to Westminster

3.—(1) The area which is marked E on the map shall be transferred from the Royal Borough, and from the Colville ward to Westminster, to the Westbourne ward, and to the North Westminster petty sessional area.

(2) The area which is marked B on the map shall be transferred from the Royal Borough, and from the St Charles ward to Westminster, to the Queen’s Park ward, and to the North Westminster petty sessional area.

Transfers from Westminster to the Royal Borough

4.—(1) The area which is marked A on the map shall be transferred from Westminster, and from the Queen’s Park ward to the Royal Borough, to the St Charles ward, and to the West London petty sessional area.

(2) The area which is marked C on the map shall be transferred from Westminster, and from the Queen’s Park ward to the Royal Borough, to the Golborne ward, and to the West London petty sessional area.

(3) The area which is marked D on the map shall be transferred from Westminster, and from the Westbourne ward to the Royal Borough, to the Golborne ward, and to the West London petty sessional area.

Town and country planning

5.—(1) In this article, “provision” means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990(3)).

(2) Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

Explanatory Note

(This note is not part of the Order)

This Order makes minor changes within Greater London to the boundary between the Royal Borough of Kensington and Chelsea and the City of Westminster.

The changes are all in the vicinity of Harrow Road.

The boundary is realigned—

(a)to the centre of the Grand Union Canal (Paddington Branch) between the Ladbroke Grove Bridge in the west, and the Great Western Road Bridge in the east; then

(b)to the western side of the Great Western Road; and then

(c)to the southern side of St Ervans Railway Sidings.

The effect of the realignments is to unite the Cheltenham Estate and St Ervans Sidings in Kensington and Chelsea, and to transfer Meanwhile Gardens, part of the Westway, and Westbourne Park Station to that borough.

The map at the end of this Note gives a general guide to the areas affected.

In approximate terms, the total area of land transferred from Kensington and Chelsea to Westminster is less than 1 hectare, with no population, and from Westminster to Kensington and Chelsea, 6 hectares, with a population of 170.

For full details of the transfers made, the order map (described in article 2) should be inspected.

Any person may inspect it at any reasonable time at the offices of the Council of the Royal Borough of Kensington and Chelsea or of the Westminster City Council, and also at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.

The Local Government Area Changes Regulations 1976 (S. I. 1976/246, amended by S. I. 1978/247) contain general provisions regarding the effect of orders such as this one.
