In exercise of the powers conferred on the Secretary of State by sections 8(5) and (7) of the Education Act 1980(1) the Secretary of State for Education and Science hereby makes the following Regulations:

Citation, commencement and application

1.—(1) These Regulations may be cited as the Education (School Information) (Amendment) (England) Regulations 1992 and shall come into force on 7th February 1992.

(2) These Regulations apply in England only.

Amendment of the Education (School Information) Regulations 1981

2.  The Education (School Information) Regulations 1981(2) are hereby amended as follows—

(1) in Regulation 5 at the end there shall be added the following paragraph:

(9)Without prejudice to the foregoing provisions of this Regulation, such particulars of the arrangements made by the relevant education authority under subsection (1) of section 7 of the Act of 1980 (appeals against admission decisions) and mentioned in subsection (1) (c) of section 8 of that Act shall also be published by being set out in any document containing a notification to parents of a decision referred to in subsection (1) of section 7 of that Act refusing their child admission to a school for which such parents have expressed a preference in accordance with arrangements made under subsection (1) of section 6 of that Act.;

(2) in Regulation 7 at the end there shall be added the following paragraph:

(5)Without prejudice to the foregoing provisions of this Regulation, such particulars of the arrangements (relating to appeals against admission decisions) mentioned in subsection (2) (b) of section 8 of the Act of 1980 shall also be published by being set out in any document containing a notification to parents of a decision referred to in subsection (2) of section 7 of that Act refusing their child admission to a school for which such parents have expressed a preference in accordance with arrangements made under subsection (1) of section 6 of that Act..

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which apply in England only and come into force on 7th February 1992, amend the Education (School Information) Regulations 1981.

The amendments provide for the publication, in pursuance of section 8(1) (c) or (2) (b) (as the case may be) of the Education Act 1980, to the parents of a child who has been refused admission to a county or controlled school maintained by an education authority or (as the case may be) to an aided or special agreement school in any document containing a notification to such parents of the decision to that effect of particulars of the arrangements made under section 7(1) or (2) (as the case may be) of that Act enabling such parents to appeal against such decision (Regulation 2(1) and (2)).
