CHANGES IN LOCAL GOVERNMENT AREAS

The Fife and Tayside Regions and North East Fife and Perth and Kinross Districts (Butterwell/Burnside) Boundaries Amendment Order 1990

Whereas under section 17(1) of the Local Government (Scotland) Act 1973(1) the Local Government Boundary Commission for Scotland on 3rd April 1989 submitted to the Secretary of State a report on a review conducted under section 14(2) of that Act in which they made proposals for the transfer of certain areas between Fife Region and Tayside Region and in which they also made proposals for changes in electoral arrangements consequential on those changes in local government areas;

Now, therefore, in exercise of the powers conferred on him by section 17(2) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order to give effect to the proposals of the Local Government Boundary Commission for Scotland as submitted to him:

Title and commencement

1.  This Order may be cited as the Fife and Tayside Regions and North East Fife and Perth and Kinross Districts (Butterwell/Burnside) Boundaries Amendment Order 1990, and shall come into force on 15th February 1990.

Interpretation

2.  In this Order–

“the 1977 Regulations” means the Local Government Area Changes (Scotland) Regula tions 1977(2); and

“boundary map 1” means the map prepared by the Scottish Office marked “The Fife and Tayside Regions and North East Fife and Perth and Kinross Districts (Butterwell/Burnside) Boundaries Amendment Order 1990 Map 1” and deposited in accordance with regulation 3 of the 1977 Regulations;

“boundary map 2” means the map prepared by the Scottish Office marked “The Fife and Tayside Regions and North East Fife and Perth and Kinross Districts (Butterwell/Burnside) Boundaries Amendment Order 1990 Map 2” and deposited in accordance with regulation 3 of the 1977 Regulations;

and, in the Schedule to this Order, any reference to a boundary of a region is a reference to a boundary existing immediately before the commencement of this Order.

Application of the 1977 Regulations

3.  Save insofar as they can have no application in relation to the area changes effected by this Order, the provisions of the 1977 Regulations shall apply in relation thereto for the purposes of, or in consequence of, this Order.

Area changes

4.—(1) Part of North East Fife District in Fife Region, being the area A described in Part I of the Schedule to this Order and shown delineated, hatched and marked “Area A” on boundary map 1, shall be transferred to Perth and Kinross District in Tayside Region.

(2) Those parts of Perth and Kinross District in Tayside Region, being –

(a)the area B at Butterwell described in Part II of the Schedule to this Order and shown delineated, hatched and marked “Area B” on boundary map 1, and

(b)the area C at Burnside described in Part II of the Schedule to this Order and shown delineated, hatched and marked “Area C” on boundary map 2,

shall be transferred to North East Fife District in Fife Region.

Consequential changes of electoral arrangements

5.—(1) Area A described in Part I of the Schedule to this Order (being the area transferred by article 4(1) of this Order) —

(a)shall cease to form part of electoral division 22 of Fife Region(3) and of ward 5 (Auchtermuchty/Strathmiglo) of North East Fife District(4); and

(b)shall form part of electoral division 46 (Kinross) of Tayside Region(5) and of ward 28 (West Kinross) of Perth and Kinross District(6).

(2) Each of areas B and C described in Part II of the Schedule to this Order (being the areas transferred by article 4(2) of this Order)–

(a)shall cease to form part of electoral division 46 (Kinross) of Tayside Region and of ward 28 (West Kinross) of Perth and Kinross District; and

(b)shall form part of electoral division 22 of Fife Region and of ward 5 (Auchtermuchty/Strathmiglo) of North East Fife District.

SCHEDULE

PART I

Area A

The area bounded by a line commencing on the Fife/Tayside regional boundary north-east of Mawcarse Railway Bridge at a point grid reference No 1532 0610; south-eastwards by fence line across a disused railway line to rejoin the said regional boundary at a point grid reference No 1534 0608; then south-westwards, north-westwards and north-eastwards along the said regional boundary to the point of commencement.

PART II

Area B

The area bounded by a line commencing on the Fife/Tayside regional boundary at the Butterwell Burn at a point grid reference No 1580 0620; south-eastwards by field boundary to the western curtilage boundary of property known as Butterwell House; then south-westwards and south-eastwards along the curtilage boundary fence line to a point grid reference No 1585 0611 on the western side of the unclassified road connecting Butterwell and the B919 road; thereafter across the unclassified road to a point on its eastern side grid reference No 1586 0610; then north-eastwards along that side of the unclassified road to rejoin the said regional boundary at the Butterwell Burn at a point grid reference No 1594 0620; then north-westwards and south-westwards along the said regional boundary to the point of commencement.

Area C

The area bounded by a line commencing on the Fife/Tayside regional boundary at a point on the west side of the unclassified road connecting Butterwell and the A91 road grid reference No 1625 0777; northwards along the west side of that unclassified road to a point on the southern boundary of the A91 road grid reference No 1624 0782; south-westwards along the south side of that road to a point grid reference No 1622 0781; then north-westwards across the A91 road to a point at the wall bounding the western side of the curtilage of property known as Burnside Toll House grid reference No 1620 0784; then continuing north-westwards and generally north-eastwards by that wall and then by fence to rejoin the said regional boundary at a point grid reference No 1621 0792; then south-eastwards, north-eastw ards, south-eastwards and south-westwards along the said regional boundary to the point of commencement.

Explanatory Note

(This note is not part of the Order)

This order transfers an area of approximately 0.2 hectares from Fife Region to Tayside Region and 2 areas at Butterwell and Burnside which together extend to approximately 2.44 hectares from Tayside Region to Fife Region, and makes consequential changes to electoral arrangements.

The map annexed to and forming part of this note gives a general guide to the areas affected by this Order as from 15th February 1990.

Copies of the detailed boundary maps defined in article 2 of this Order may be inspected at the offices of any of the local authorities referred to in this Order, and may be inspected at or purchased from the Scottish Development Department’s Map Library, New St Andrew’s House, St James Centre, Edinburgh, EH1 3SZ.
