John MacGregor

Secretary of State for Education and Science

16th January 1990

Explanatory Note

(This note is not part of the Order)

1.  This Order provides for the transfer of certain categories of staff who are in the service of the Inner London Education Authority (“ILEA”) immediately before the abolition of that authority on 1st April 1990. Any member of staff occupying a teaching or non-teaching post in a school or specified institution of further and higher education on 29th September 1989 who is still in post on 31st March 1990, or person who replaces such a member of staff and is in post on 31st March 1990, is designated for transfer to the inner London council which takes over responsibility for the school or institution in question. The Order makes similar provision with regard to the designation of peripatetic and supply teachers, determining the inner London council to which such staff are to be transferred; and with regard to the designation for transfer to specified councils of further specified groups of staff. It also provides for the designation to the London Residuary Body of persons employed in the Greater London Supplies Division of the ILEA Supplies and Transport Services Branch who on 31st March 1990 are seconded to that Body, the staff of Woolverstone Hall School, and of other named persons.

2.  The effect of designation is that the contract of employment between the member of staff and ILEA is treated from the abolition of ILEA as if originally made between that member of staff and the successor employer; there is no termination of, or change in the terms of, the contract of employment.

(2)

Published by ILEA in March 1988; copies may be inspected at County Hall, London SE1.

(4)

1987 c. 1; section 7(1) was amended in a manner not relevant to this Order by paragraph 39 of Schedule 12 to the Education Reform Act 1988.
