The Secretary of State in exercise of the powers conferred upon him by sections 2(2)(a) and 190(1) of the Local Government and Housing Act 1989(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Local Government (Politically Restricted Posts) Regulations 1990 and shall come into force on 6th February 1990.

(2) In these Regulations “the 1989 Act” means the Local Government and Housing Act 1989.

(3) References in these Regulations to the area of the City of London, London boroughs, or districts are to the area of the councils concerned.

2.—(1) The annual rate of remuneration specified for the purposes of section 2(2) of the 1989 Act in respect of full time posts shall be the amount shown in column 2 of the Schedule to these Regulations for the area shown in column 1 of the Schedule in which the duties of the post are principally discharged.

(2) The annual rate of remuneration specified for the purposes of section 2(2) of the 1989 Act in respect of full time posts where the duties of the post are discharged in more than one of the areas shown in column 1 of the Schedule but are not discharged principally in any one area, shall be theamount shown in column 2 of the Schedule for any one of the areas in which the duties of the post are discharged and where those amounts differ shall be the higher of those amounts.

Explanatory Note

(This note is not part of the Regulations)

Local Authorities are under a duty to prepare and maintain a list of posts in respect of which the annual rate of remuneration is £19,500 or above.

These Regulations, which apply to the whole of Great Britain, increase the annual rate of remuneration at which posts are required to be entered in the list. The increased amount for posts in England and Wales is in some cases £19,632, which is the annual rate of remuneration currently attributed to spinal column point 44 by the National Joint Council for Local Authorities' Administrative, Professional, Technical and Clerical Services and for posts in Scotland is £19,650.

In other cases, in England and Wales, the annual rate of remuneration which is specified is a higher amount and includes inner London weighting of £1722, outer London weighting of £912, inner fringe allowance of £411 and outer fringe allowance of £282 a year, according generally to the area in which the duties of the post are principally discharged.
