CHRONICALLY SICK AND DISABLED PERSONS

The Secretary of State for Social Services in exercise of the powers conferred on him by section 18(2) of the Disabled Persons (Services, Consultation and Representation) Act 1986(1), and of all other powers enabling him in that behalf, hereby makes the following Order:—
1.—(1) This Order may be cited as the Disabled Persons (Services, Consultation and Representation) Act 1986 (Commencement No. 4) Order 1988.
(2) This Order shall not apply to Scotland.
(3) In this Order“the Act” means the Disabled Persons (Services, Consultation and Representation) Act 1986.
2. The provisions of the Act specified in column 1 of the Schedule to this Order (which relate to the matters specified in column 2 thereof) shall come into force on 1st February 1988.

This Order brings into force on 1st February 1988 sections 5 and 6 of the Disabled Persons (Services, Consultation and Representation) Act 1986. Section 5 imposes a duty on local education authorities to require appropriate officers of local social services authorities to give their opinion whether children who are receiving special education are disabled persons and imposes duties on local education authorities to notify local social services authorities when disabled persons receiving special education will leave full-time education and on local social services authorities to carry out assessments of their needs under certain welfare enactments; section 6 requires local education authorities to keep under review the dates when disabled children receiving special education are expected to leave full-time education at school or further education establishments to ensure that notices are given to local social services authorities and assessments made under section 5 of the Act.
