Coming into force in accordance with regulation 1(2) and (3)

The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 43A(1)(a)(ii), (4), (10), (11), (13) and (17), 275 and 275A of the Town and Country Planning (Scotland) Act 1997(1) and all other powers enabling them to do so.

1997 c. 8. Sections 43A and 275A were respectively inserted into the Town and Country Planning (Scotland) Act 1997 (c.8) (“the Act”) by section 17 and 52 of the Planning etc. (Scotland) Act 2006 (asp 17) (the “2006 Act”). Section 275 of the Act was amended by section 53(16) of the 2006 Act. The functions of the Secretary of State under the Act transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). See section 277(1) of the Act for the definition of “prescribed”.
