The Department of Health, Social Services and Public Safety(1), in conjunction with the Department of Finance and Personnel, makes the following Regulations in exercise of the powers conferred by Articles 63(1), (2), 63AA, 64, 106(b) and 107(6) of the Health and Personal Social Services (Northern Ireland) Order 1972(2).
In accordance with Article 63(3) of that Order, the Department of Health, Social Services and Public Safety has consulted with such organisations as appear to it to be representative of the pharmaceutical profession.
1.—(1) These Regulations may be cited as the Pharmaceutical Services (Amendment) Regulations (Northern Ireland) 2010 and shall come into operation on 1st April 2010.
(2) In these Regulations “the Pharmaceutical Regulations” means the Pharmaceutical Services Regulations (Northern Ireland) 1997(3).
2.—(1) The Pharmaceutical Regulations are amended as follows.
(2) In regulation 2(1) (Interpretation), omit the definition of “the Charges for Drugs and Appliances Regulations”(4).
(3) For regulation 4(2)(c)(i) (Additional professional services), substitute—
“(i)who is aged 60 or over; or”.
(4) In Schedule 2, omit paragraphs 2(2B)(5) and 14A(6).

These Regulations further amend the Pharmaceutical Services Regulations (Northern Ireland) 1997 (“the Pharmaceutical Regulations”) which regulate the terms on which pharmaceutical services are provided under the Health and Personal Social Services (Northern Ireland) Order 1972.
They contain amendments to the provisions of the Pharmaceutical Regulations consequential to the revocation of the Charges for Drugs and Appliances Regulations (Northern Ireland) 1997.

Paragraph 2(2B) was inserted into Schedule 2 by S.R. 1999 No. 254 regulation 2(4) and substituted by S.R. 2005 No. 231 regulation 13(3)(e)
Paragraph 14A was inserted into Schedule 2 by S.R. 1999 No. 254 regulation 2(5) and amended by S.R. 2002 No.397 regulation 3(c) and S.R. 2005 No. 231 regulation 13(11)
