Coming into operation

The Department of Health, Social Services and Public Safety1, in conjunction with the Department of Finance and Personnel, makes the following Regulations in exercise of the powers conferred by Articles 63(1), (2), 63AA, 64, 106(b) and 107(6) of the Health and Personal Social Services (Northern Ireland) Order 19722.

In accordance with Article 63(3) of that Order, the Department of Health, Social Services and Public Safety has consulted with such organisations as appear to it to be representative of the pharmaceutical profession.

Citation, commencement and interpretation1

These Regulations may be cited as the Pharmaceutical Services (Amendment) Regulations (Northern Ireland) 2010 and shall come into operation on 1st April 2010.

In these Regulations “the Pharmaceutical Regulations” means the Pharmaceutical Services Regulations (Northern Ireland) 19973.

Amendment of the Pharmaceutical Regulations2

The Pharmaceutical Regulations are amended as follows.

In regulation 2(1) (Interpretation), omit the definition of “the Charges for Drugs and Appliances Regulations”4.

For regulation 4(2)(c)(i) (Additional professional services), substitute—

who is aged 60 or over; or

In Schedule 2, omit paragraphs 2(2B)5 and 14A6.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations further amend the Pharmaceutical Services Regulations (Northern Ireland) 1997 (“the Pharmaceutical Regulations”) which regulate the terms on which pharmaceutical services are provided under the Health and Personal Social Services (Northern Ireland) Order 1972.

They contain amendments to the provisions of the Pharmaceutical Regulations consequential to the revocation of the Charges for Drugs and Appliances Regulations (Northern Ireland) 1997.
