National Health Service Commissioning Board and Clinical Commissioning Groups (Responsibilities and Standing Rules) Regulations 2012

29.—(1) The National Health Service Commissioning Board and Clinical Commissioning Groups (Responsibilities and Standing Rules) Regulations 2012(1) are amended as follows.

(2) In regulation 2(1) (interpretation), in the definition of “secure children’s home”, at the end, insert “, or premises in respect of which a person is registered under Part 1 of the Regulation and Inspection of Social Care (Wales) Act 2016 to provide a secure accommodation service within the meaning of Part 1 of and Schedule 1 to that Act”.

(3) In Schedule 1 (additional persons for whom a CCG has responsibility), in paragraph 1—

(a) for the definition of ““care home” and “children’s home”” substitute—

““care home”—

(a)

in England, has the same meaning as in the Care Standards Act 2000, and

(b)

in Wales, means a care home service, within the meaning of Part 1 of the Regulation and Inspection of Social Care (Wales) Act 2016, which is provided wholly or mainly to adults;”;

(b) in the appropriate place insert—

““children’s home”—

(a)

in England, has the same meaning as in the Care Standards Act 2000, and

(b)

in Wales, means a care home service, within the meaning of Part 1 of the Regulation and Inspection of Social Care (Wales) Act 2016, which is provided wholly or mainly to children;”.
