Ystyriaeth ffurfiol
35.—(1) Rhaid i gwynion yr ymdrinnir â hwy drwy ystyriaeth ffurfiol(1) gael eu datrys cyn gynted ag y bo'n rhesymol ymarferol, a beth bynnag o fewn 35 diwrnod gwaith ar ôl gwneud cais am ystyriaeth ffurfiol.
(2) Rhaid i'r person cofrestredig roi cadarnhad ysgrifenedig o ganlyniad yr ystyriaeth ffurfiol i'r achwynydd, ynghyd â chrynodeb o natur a sylwedd y gŵyn, y casgliadau a'r camau sydd i'w cymryd o ganlyniad.
(3) Rhaid i'r person cofrestredig anfon copi o'r ymateb ysgrifenedig i gŵyn i'r swyddfa briodol ac at unrhyw awdurdod lleol a drefnodd ar gyfer gwarchod neu ddarparu gofal dydd i blentyn perthnasol.
(4) Ceir estyn y terfyn amser ym mharagraff (1) os yw'r achwynydd yn cydsynio.
(5) Os na fydd y gŵyn wedi ei datrys o fewn 35 diwrnod ar ôl gwneud y cais am ystyriaeth ffurfiol, rhaid i'r person cofrestredig hysbysu'r swyddfa briodol ynglŷn â'r gŵyn a'r rhesymau dros yr oedi cyn ei datrys.

Rhaid dehongli “ystyriaeth ffurfiol” yn unol â'r egwyddorion a bennir yn Gwrando a Dysgu: canllawiau ar ddelio â chwynion a sylwadau yng ngwasanaethau llywodraeth leol yng Nghymru (ISBN 0 - 11- 091240 - 3) a gyhoeddwyd gan Lywodraeth Cynulliad Cymru yn 2005.
