The Welsh Ministers, in exercise of the powers conferred upon the National Assembly for Wales by sections 112 and 210 of the Education Act 2002(1) and now vested in them(2), and having made such arrangements for consultation about the proposals as it considers appropriate in accordance with section 117 of that Act, make the following Regulations:

Title, commencement and application

1.—(1) The title of these Regulations is the Education (Disapplication of the National Curriculum for Wales at Key Stage 1) (Wales) Regulations 2008.

(2) The provisions of these Regulations come into force—

(a)on 1 August 2010 in respect of pupils in the third year of the foundation stage; and

(b)on 1 August 2011 in respect of pupils in the fourth year of the foundation stage.

(3) These Regulations apply in relation to Wales.

Interpretation

2.  In these Regulations —

“the 2002 Act” (“Deddf 2002”) means the Education Act 2002;

“first key stage” (“cyfnod allweddol cyntaf”) is to be construed in accordance with section 103(1) of the 2002 Act; and

references to the foundation stage are to be construed in accordance with section 102 of the 2002 Act.

Disapplication of the National Curriculum for Wales at Key Stage 1

3.  The requirements of the National Curriculum for Wales for the first key stage as set out in section 105(1), (2) and, (3) and in the Orders made under section 108(3)(3) of the 2002 Act are not to apply in relation to pupils at maintained schools during the school years 2010 to 2011 and 2011 to 2012.

Explanatory Note

(This note is not part of the Regulations)

These Regulations made under the Education Act 2002 provide for the disapplication of the requirements of the National Curriculum for Wales specified for the first key stage in section 105(1), (2), and (3), and Orders made under section 108(3) of the Education Act 2002 for pupils at maintained schools for the school years 2010 to 2011 and 2011 to 2012.

These Regulations will come into force at the same time as the foundation stage is introduced. The foundation stage will be introduced for the first year of the foundation stage on 1 August 2008 for those pupils aged 3 to 4 years, for the second year of the foundation stage on 1 August 2009 for those pupils aged 4 to 5 years, for the third year of the foundation stage on 1 August 2010 for those pupils aged 5 to 6 and for the fourth year on 1 August 2011 for those pupils aged 6 to 7 years.

The functions of the National Assembly for Wales under these sections were transferred to the Welsh Ministers under paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
