Cyfyngiadau ar bersonau i gymryd rhan mewn trafodion

9.—(1) Yn y rheoliad hwn ac yn yr Atodlen ystyr “person perthnasol” (“relevant person”) yw aelod o'r cyd-bwyllgor, pennaeth (p'un a yw'n aelod o'r cyd-bwyllgor ai peidio) neu unrhyw berson a benodwyd yn glerc i'r cyd-bwyllgor.

(2) Yn ddarostyngedig i baragraff (4)—

(a)os gall gwrthdaro ddigwydd ynghylch unrhyw fater rhwng buddiannau person perthnasol a buddiannau corff llywodraethu sy'n cydweithredu;

(b)os bydd gwrandawiad teg yn ofynnol a bod unrhyw amheuaeth resymol ynghylch gallu person perthnasol i weithredu'n ddiduedd ynglyn ag unrhyw fater; neu

(c)os bydd gan berson perthnasol fuddiant ariannol yn unrhyw fater;

rhaid i'r person hwnnw, os yw'n bresennol mewn cyfarfod o'r cyd-bwyllgor pan fydd y mater yn destun ystyriaeth, ddatgelu ei fuddiant, ymneilltuo o'r cyfarfod a pheidio â phleidleisio ar y mater o dan sylw.

(3) Ni ddylid dehongli bod dim yn y rheoliad hwn neu yn yr Atodlen sy'n atal—

(a)y cyd-bwyllgor rhag—

(i)caniatáu i berson sy'n ymddangos ger ei fron i roi tystiolaeth i fynychu unrhyw wrandawiad a gynhelir ganddo i unrhyw fater a chyflwyno'i dystiolaeth; neu

(ii)gwrando ar sylwadau gan berson perthnasol sy'n gweithredu mewn swyddogaeth heblaw person perthnasol;

(b)person perthnasol rhag ymrwymo mewn contract â chorff llywodraethu sy'n cydweithredu y mae ganddo'r hawl i elwa ohono.

(4) Nid yw'n ofynnol i berson sy'n gweithredu fel clerc mewn cyfarfod cyd-bwyllgor ymneilltuo o gyfarfod o dan y rheoliad hwn neu'r Atodlen onid yw ei benodiad i'r swydd, ei dâl, neu gamau disgyblu yn ei erbyn yn destun ystyriaeth, ond os byddai'r rheoliad hwn neu'r Atodlen fel arall yn ei gwneud yn ofynnol iddo ymneilltuo, rhaid iddo beidio â gweithredu mewn unrhyw swyddogaeth heblaw swyddogaeth clerc.

(5) Os oes unrhyw anghydfod ynghylch p'un a yw'n ofynnol o dan y rheoliad hwn i berson perthnasol ymneilltuo o gyfarfod cyd-bwyllgor a pheidio â phleidleisio ar y cwestiwn hwnnw rhaid i aelodau eraill y cyd-bwyllgor sy'n bresennol yn y cyfarfod benderfynu arno.

(6) Mae'r Atodlen yn gwneud darpariaeth ar gyfer buddiannau ariannol a gwrthdrawiadau penodedig eraill o ran buddiant.
