Hysbysiad ymlaen llaw
4.—(1) Mae person sydd â gofal unrhyw gwch pysgota y mae Erthygl 8 o Reoliad 811/04 yn gymwys iddo, sy'n dod i borthladd yng Nghymru heb roi'r wybodaeth y mae'r Erthygl honno'n gofyn amdani, yn euog o dramgwydd.
(2) Caniateir i swyddog pysgodfeydd môr Prydeinig, drwy gyfarwyddyd ysgrifenedig neu ar lafar i'r person sydd â gofal unrhyw gwch pysgota y mae Erthygl 8(2) o Reoliad 811/04 yn gymwys iddo ac sy'n glanio mewn porthladd yng Nghymru, ei gwneud yn ofynnol nad yw'r dadlwytho y cyfeirir ato yn Erthygl 8(2) o Reoliad 811/04 yn cychwyn hyd nes bod swyddog pysgodfeydd môr Prydeinig yn ei awdurdodi.
(3) Mae person sydd â gofal cwch pysgota y dadlwythir ohono'n groes i unrhyw ofyniad o dan baragraff (2) yn euog o dramgwydd.
(4) Mae person sydd â gofal unrhyw gwch pysgota y mae Erthygl 8(3) o Reoliad 811/04 yn gymwys iddo sy'n methu â rhoi gwybodaeth fel sy'n ofynnol gan yr Erthygl honno yn euog o dramgwydd.
(5) At ddibenion paragraff (1) a (4), mae'r wybodaeth i'w roi i Cynulliad Cenedlaethol Cymru.
