Ystyr “damage to the environment” ayb

5.—( 1) Mae diwygiadau adran 107 o'r Ddeddf (ystyr “damage to the environment” ayb) a wnaed gan reoliad 4 o Reoliadau Organeddau a Addaswyd yn Enetig (Eu Gollwng yn Fwriadol) 2002, fel y'u disgrifir ym mharagraff (2), yn effeithiol hefyd mewn perthynas â Chymru.

(2) Mae'r diwygiadau y cyfeirir atynt ym mharagraff (1)—

(a) yn rhoi yn lle is-adran (2) (ystyr “environment”)—

“(2) The “environment” includes land, air and water and living organisms supported by any of those media”,

(b) yn is-adran (3) (ystyr “damage to the environment”) yn hepgor “to the living organisms supported by the environment”,

(c) yn rhoi yn lle is-adran (6) (ystyr “harm”)—

“(6) “Harm” means any adverse effects as regards the health of humans or the environment”,

(ch) yn rhoi yn lle is-adran (9) (ystyr organedd sydd o dan “control” person)—

“(9) Organisms of any description are under the “control” of a person where he keeps them contained by measures designed to limit their contact with humans and the environment and to prevent or minimise the risk of harm.”,

(d) yn rhoi yn lle is-adran (11) (ystyr organedd sy'n cael ei farchnata (“marketed”))—

“(11) Genetically modified organisms of any description are “marketed” by a person when products consisting of or including such organisms are placed on the market by being made available to other persons, whether or not for consideration.”.
