The Office of Communications (“OFCOM”), in exercise of the powers conferred by sections 71(4), 71(5), 71(7), 71(9) and 403(7) of the Communications Act 2003(1), makes the following Regulations.

Before making these Regulations, OFCOM have given notice of their proposal to do so in accordance with section 403(4)(a) of the Act, published notice of their proposal in accordance with section 403(4)(b) of the Act, and have considered the representations made to them before the time specified in the notice in accordance with section 403(4)(c) of the Act.

Citation and commencement

1.  These Regulations may be cited as the Electronic Communications (Universal Service) (Costs) (Amendment) Regulations 2021 and shall come into force on 24th December 2021.

Amendments

2.  The Electronic Communications (Universal Service) (Costs) Regulations 2020(2) are amended as follows—

(a)in regulation 2, after ““outstanding sum” has the meaning given in regulation 15(1);” insert in a new line ““public funds” means money provided by Parliament;”; and

(b)in regulations 7(2)(a), 7(3) and 15(2)(e) for “central funds” substitute “public funds”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Electronic Communications (Universal Service) (Costs) Regulations 2020 (S.I. 2020/545) (the “2020 Regulations”).

Regulations 2(a) and 2(b) substitute the term “central funds” for “public funds” wherever it is used in the 2020 Regulations and insert a definition of public funds.

A regulatory impact assessment of the effect that the 2020 Regulations will have on cost to business is available to the public from OFCOM’s website at http://www.ofcom.org.uk or from the OFCOM library at Riverside House, 2a Southwark Bridge Road, London SE1 9HA. Copies of this assessment have also been placed in the library of the House of Commons. There are no additional impacts arising from these Regulations which make corrections to the 2020 Regulations.
