The Secretary of State makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1).
The Secretary of State is designated for the purposes of section 2(2) of that Act in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type-approval scheme(2).
1. These Regulations may be cited as the Road Vehicles and Non-Road Mobile Machinery (Type Approval) (Amendment) (EU Exit) (No. 2) Regulations 2019 and come into force on the day after these Regulations are laid.
2. In the Road Vehicles and Non-Road Mobile Machinery (Type Approval) (Amendment) (EU Exit) Regulations 2019(3), in regulation 1(b)(i), for “22 days after the day on which these Regulations are made”, substitute “on 29th March 2019”.

These Regulations amend the Road Vehicles and Non-Road Mobile Machinery (Type Approval) (Amendment) (EU Exit) Regulations 2019 (S.I. 2019/648) (“the principal Regulations”) to vary the date for commencement of Part 3 of that instrument (which provides for amendments under the European Communities Act 1972 (c. 68) to be made to definitions in the Road Traffic (Northern Ireland) Order 1981 (S.I. 1981/154 (N.I. 1)). This is necessary due to the late making of the principal Regulations such that Part 3 would not properly commence before exit day.
An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.

Section 2(2) was amended by section 27(1) of the Legislative and Regulatory Reform Act 2006 (c. 51) and by section 3(3) of, and Part 1 of the Schedule to, the European Union (Amendment) Act 2008 (c. 7). Paragraph 1A of Schedule 2 was inserted by section 28 of the Legislative and Regulatory Reform Act 2006 and amended by Part 1 of the Schedule to the European Union (Amendment) Act 2008 and S.I. 2007/1388.
