The Secretary of State makes the following Order in exercise of the power conferred by section 123(4)(a) of the Education Act 2002 M1.

1.—(1) This Order may be cited as the School Teachers' Incentive Payments (England) Order 2019 and comes into force on 1st September 2019.

(2) This Order applies only in relation to school teachers in England.

Incentive payments to school teachersE+W

2.—(1) A lump sum payment made by the Secretary of State to a school teacher under one of the schemes mentioned in paragraph (2) is not to be treated as remuneration for the purpose of section 122(1) of the Education Act 2002.

(2) The schemes are—

(c)the Teachers' Student Loan Reimbursement Pilot, F3...

Explanatory Note

(This note is not part of the Order)

This Order provides that lump sum payments paid under the three schemes mentioned in article 2(2) to school teachers in England are not treated as remuneration for the purpose of section 122(1) of the Education Act 2002 and so are not subject to the statutory pay framework and are not pensionable.

This Order revokes the School Teachers' Incentive Payments (England) Order 2018 which referred to payments made by local authorities and governing bodies of schools. This Order replaces that Order because the maker of the intended payments will now be the Secretary of State and not local authorities and governing bodies of schools and this Order makes the appropriate provision.

An impact assessment has not been produced for this instrument as it has no impact on business or civil society organisations. The instrument has minimal impact on the public sector.
