The Secretary of State makes the following Order in exercise of the power conferred by section 25(3) of the Apprenticeships, Skills, Children and Learning Act 2009(1).

In accordance with section 25(4) of the Apprenticeships, Skills, Children and Learning Act 2009, the Secretary of State is satisfied that the Specification of Apprenticeship Standards for England, as modified by this Order, complies with section 27 of that Act(2).

Citation and commencement

1.  This Order may be cited as the Apprenticeships (Modifications to the Specification of Apprenticeship Standards for England) Order 2018 and comes into force on 21st September 2018.

Modifications to the Specification of Apprenticeship Standards for England

2.  The document entitled “Specification of Apprenticeship Standards for England (SASE)” published by the Secretary of State on 20th January 2011, with ISBN 978-0-85605-726-7, and as modified by the documents entitled—

(a)“Specification of Apprenticeship Standards for England (SASE)” published by the Secretary of State on 7th March 2013, with ISBN 978-0-85605-727-4,

(b)“Specification of Apprenticeship Standards for England (SASE)” published by the Secretary of State on 12th February 2015, with unique reference number BIS/15/14, and

(c)“Specification of Apprenticeship Standards for England (SASE)” published by the Secretary of State on 5th October 2015, with unique reference number BIS/15/572,

(d)“Specification of Apprenticeship Standards for England (SASE)” published by the Secretary of State on 30th March 2017, with unique reference number DFE-00092-2017,

(e)“Specification of Apprenticeship Standards for England (SASE)” published by the Secretary of State on 19th July 2017, with unique reference number DFE-00167-2017,

has effect with the further modifications contained in the document entitled “Specification of Apprenticeship Standards for England (SASE)” published by the Secretary of State on 17th August 2018, with unique reference number DFE-00236-2018(3).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order, made under section 25(3) of the Apprenticeships, Skills, Children and Learning Act 2009 (c. 22) (“the Act”), brings into effect modifications to the Specification of Apprenticeship Standards for England. Section 25(3) of the Act was repealed by paragraph 12 of Schedule 1 to the Deregulation Act 2015 (c. 20) other than as it applies in relation to England by virtue of provision made under section 115(9) of that Act. Such provision was made in relation to section 25(3) by article 13 of, and paragraphs 2 to 4 and 7 of the Schedule to, the Deregulation Act 2015 (Commencement No. 1 and Transitional and Saving Provisions) Order 2015.

This Order specifies that the document entitled “Specification of Apprenticeship Standards for England (SASE)” has effect with the modifications referred to in article 2. Article 2 refers to the consolidated version of that document, incorporating all of the modifications to it, published by the Secretary of State on 17th August 2018 with unique reference number DFE-00236-2018. The Specification of Apprenticeship Standards for England can be found on the government website at www.gov.uk/government/publications/specification-of-apprenticeship-standards-for-england. A printed copy of the publication can be obtained by post from the Higher and Further Education Directorate, Department for Education, Sanctuary Buildings, 20 Great Smith Street, London, SW1P 3BT.

The Specification of Apprenticeship Standards for England specifies the requirements that must be met for recognised English apprenticeship frameworks to be issued under section 14(1) of the Act.

An impact assessment has not been produced for the instrument as no impact on the private or voluntary sectors is foreseen.

An Explanatory Memorandum has been prepared and is available alongside this Order at www.legislation.gov.uk .

2009 c. 22. Section 25(3) of the Apprenticeships, Skills, Children and Learning Act 2009 was repealed by paragraph 12 of Schedule 1 to the Deregulation Act 2015 (c. 20), but saved (under the power to make transitional and saving provision at section 115(9) of the Deregulation Act 2015) by article 13 of, and paragraphs 2 and 3 of the Schedule to, the Deregulation Act 2015 (Commencement No. 1 and Transitional and Saving Provisions) Order 2015 (S.I. 2015/994), subject to the provisions made at paragraphs 4 and 7 of the Schedule to that Order.
