The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) (“the ECA 1972”) and section 71A(1) and (2) of the Town and Country Planning Act 1990(2).
The Secretary of State has been designated for the purposes of section 2(2) of the ECA 1972 in relation to the environment(3).
1972 c. 68; section 2(2) was amended by section 27(1)(a) of the Legislative and Regulatory Reform Act 2006 (c. 51) and by Part 1 of the Schedule to the European Union (Amendment) Act 2008 (c. 7). By virtue of the amendment of section 1(2) of the European Communities Act 1972 by section 1 of the European Economic Area Act 1993 (c. 51), regulations may be made under section 2(2) of the European Communities Act 1972 to implement obligations created or arising under the Agreement on the European Economic Area signed at Oporto on 2nd May 1992 together with the Protocol adjusting that Agreement signed at Brussels on 17th March 1993. Annex XX to that Agreement provides that the term “Member State” in Directive 2011/92/EU includes Iceland, Liechtenstein and Norway. Regulations 4 and 11 of these Regulations make provision in relation to “EEA States”.
1990 c. 8. Section 71A was inserted by section 15 of the Planning and Compensation Act 1991 (c. 34), and amended by paragraphs 1 and 16 of Schedule 12 to the Housing and Planning Act 2016 (c. 22) and S.I. 2011/1043.
