The Consumer Rights Act 2015 (Commencement) (England) Order 2015

The Secretary of State, in exercise of the powers conferred by section 100 (3)(a), (5) and (6) of the Consumer Rights Act 2015(1), makes the following Order:

Citation and application

1.—(1) This Order may be cited as the Consumer Rights Act 2015 (Commencement) (England) Order 2015.

(2) This Order applies in relation to England only.

Provisions coming into force on 27th May 2015

2.  The following provisions of the Consumer Rights Act 2015 come into force on 27th May 2015—

(a)Chapter 3 of Part 3, insofar as it is not already in force;

(b)section 77 and Schedule 5 insofar as they relate to Chapter 3 of Part 3; and

(c)Schedule 9.

EXPLANATORY NOTE

(This note is not part of the Order)

This is the first Commencement Order made under the Consumer Rights Act 2015 (c.15). Certain provisions came into force on the passing of the Act. This Order applies in relation to England only.

This Order brings into force, on 27th May 2015, Chapter 3 of Part 3 of the Act, insofar as it is not already in force. This requires letting agents to publicise relevant fees at their premises and on their website. It requires letting agents who are required to be a member of a redress scheme for dealing with complaints, to display details of that redress scheme, and certain agents who hold client money to display a statement of whether or not they are a member of a client money protection scheme. It further provides for enforcement of these duties by a local weights and measures authority. Upon the passing of this Act, Chapter 3 of Part 3 came into force insofar as it confers power to make regulations, as did section 88(5) to (11) of the Act which makes further provision in relation to those regulations.

The Order brings into force section 77 of, and Schedule 5 to the Act which deals with investigatory powers, insofar as they relate to Chapter 3 of Part 3.

The Order also brings into force Schedule 9 to the Act which deals with financial penalties.

An impact assessment of the effect that the Act will have on the costs of business and the voluntary sector has been produced, and a copy is available on request from DCLG.
